    @gr1p Sorry I meant the date it happened is 20.08.24 which under the POC it says the PCN was issued on that date. I was thinking that’s correct but that’s actually wrong?

    I will draft something over the next few days and put it on here. First I need to complete the AOS and email it, so annoyed I can’t do it online- I will try again tomorrow- just in case!

    Check for any confusion if the password contains a lowercase letter 'L' which you've read as a number '1' or vice versa.
    Similarly, check any upper or lower case 'O', 'o' and '0'.

    If that was true then it would have been a windscreen pcn,  followed several weeks later by a postal PCN 

    As you now realise,  the pcn was not issued on the incident date but on a later date , so the POC date is incorrect 

    Ergo, no pcn was issued on the date in the POC details !  Defective Particulars,  like dozens of other cases we see 

    I suggest that you start to trust our replies,  not your newbieness to the topic, dont overthink this,  use the knowledge you are being given on here,  it's valuable and it's free  !

    Once in the government gateway,  use the claim form reference and password to access the case itself,  but everything is case sensitive and must be done correctly,  including each character,  as KeithP says above

    Passwords for Government Gateway usually give the password such as N93D...... followed by the NATO equivalent. November, 9, 3 Delta...........
    Also make sure that all of this is done in the name of the registered keeper, i.e the person to whom the N1SDT claim form was issued.

    Finally got the password to work- I thought I’d tried all the combinations but it was a capital I (India😆), that looked like an l (lima), I’d tried a number 1 and all sorts!
    That’s a big weight off my mind now the AOS is in!
    Will type my defence soon for you lovely people to check ☺️

    Ok here is my first draft of my defence. I'm not sure whether to name the company that spoke to UKPC - it was Starbucks, so if I should edit that in I will. Also, not sure how much more to put about why the car was there in paragraph 3.1? Should I say it did go over the allocated time but only just over the grace period as a child needed the toilet?? Or just not go into that side of it, as basically my defence is that I thought it had been cancelled anyway? Also, not sure about that last bit - I got a bit ranty!

    2. The facts in this defence come from the Defendant's own knowledge and honest belief.  Conversely, the Claimant sets out a cut-and-paste incoherent and sparse statement of case. The POC appear to be in breach of CPR 16.4, 16PD3 and 16PD7, and fail to "state all facts necessary for the purpose of formulating a complete cause of action". The Defendant is unable, on the basis of the POC, to understand with certainty what case, allegation(s) and what heads of cost are being pursued, making it difficult to respond. However, the vehicle is recognised and it is admitted that the Defendant was the registered keeper but was NOT the driver at the time.

    3. Referring to the POC: paragraph 1 is denied. The Defendant is not indebted to the Claimant. Paragraph 2 is denied. No PCN was "issued on 20/08/2024" (the date of the alleged visit).  Whilst the Defendant is the registered keeper, paragraphs 3 and 4 are denied. The Defendant is not liable and has seen no evidence of a breach of prominent terms.  The quantum is hugely exaggerated (no PCN can be £170 on private land) and there were no damages incurred whatsoever. The Claimant is put to strict proof of all of their allegations.

     3.1 The defendant was not the driver. The car was at the retail park as the driver was spending a lot of money in the shops. Upon receiving the PCN, the defendant reached out to one of the companies at the retail park to complain. The company then contacted UKPC and asked them to cancel the PCN which they did on 05.09.24. The defendant was told it had been cancelled and to let the company know if the defendant received more letters. 

    On the 10.09.24 the defendant received a reminder letter. The defendant spoke to the company again on 10.09.24, who again confirmed it was cancelled and to ignore letters as they are sent out automatically. 

    After receiving the Claim Form the defendant spoke to the company again on 05.02.25. They were extremely sorry and couldn’t understand why the defendant was still receiving these. The company then spoke to UKPC on the telephone – the same person they had emailed about the PCN, and UKPC again said it was cancelled. The company are devastated that the defendant was sent a Court Claim Form as the PCN was definitely cancelled in September. 

    Furthermore, when entering the claim number into UKPC's own website it states that it is an invalid claim number, most likely due to the fact that UKPC have indeed cancelled this PCN and it is only DCB Legal that are harassing the defendant for money.

    Good, Add paragraph numbers then the rest of the template defence para 4 onwards but all re-numbered.

    Then your husband signs and dates it and he (not you) emails it then reads the rest of the first 12 steps in the Template Defence thread so you don't come back here to ask us, when the first tedious letter arrives (please don't).
