Returning prom dress’s to Australia

Good day all. We have recently purchased 4 or 5 prom dresses from Australia for my daughter. None of them fit correctly and to be honest the quality is not great from the price paid. We are trying to arrange a return to them but are being met with “you can only receive store credit” and not a refund. Where do I stand with this ? It’s within the 14days and we used a credit card. Any help would be great? Are we bound by English law or Australian law which looks a little different . Many thanks.

    You're bound by Australian law as far as I know.

    If it's an Australian company (without a UK presence) then the purchase is likely to be governed by Australian law, but this should be confirmed in the terms of sale.

    Payment by credit card may open up opportunities if it can be demonstrated that the supplier breached the contract (assuming the items were all over £100 each).

    If all 4 (or 5) dresses had fitted correctly and the quality had been acceptable, would you have kept all 4 (or 5)?

    Each item needs to be over £100 if you were hoping to make a section 75 claim via your credit card provider, but that's only if the supplier has breached the contract (which doesn't sound particularly likely from what you've said).

    Do the t and c allow returns from the UK for change of mind, who is the company

    I assume you do know how many your purchased?

    Most likely Australian law.
    What did the web site say in the terms & conditions?

    There would have to have been a breach of contract under the laws of whichever jurisdiction applies.

    £100 for each items if S75 protection is to apply.



    Did you look into the return policy prior to purchase, given that 3 (or 4) dresses were always likely to be wanted to be returned?
    What was the reason for buying prom dresses from the other side of the world?
    What is the carriage costs for return back to Australia?
    Are there any customs fees on the re-import to Australia?

    This might well be one to chalk up to experience.

    Sell them and put it down to experience.

    I cannot see any claim against your card issuer.

    So you've shipped 4 (or maybe 5) prom dresses (prom dresses !!!!!!) from Australia with the intention of shipping most, if not all, of them back to Australia once you'd had a look?

    This, here, is why the planet is absolutely f*cked. 
    Or, as the Australians might say, this is totally cooked.
