copart sold my car

on the 12/11/2024 i had a car accident [ none fault ] i contacted the aa who in turn put me on to a company called ax-uk a 3rd party insurance company they took over from my insurance company they told me to cancel my insurance with geoffrey insurance as they will do all the work so i cancelled my insurance with them i emailed ax the damage done to my car. just the front bumper and headlight needed replacing  they told me it would be written off due to the age of the car they sent a company called copart a salvage company to collect my car who in turn told me my car is only worth £210.99 scrap value[ they even sent me a cheque which they later cancelled as i told them i refused there offer]   i told ax i wasn't going to accept coparts offer  and would like the car back so i can repair it my self they said ok. the 3rd party paid out £1.420 and was told i can keep the car as well.  i was told by ax-uk  copart would send my car back to me. i never heard nothing  for a couple of weeks until i looked on coparts website my car was up for auction i phoned ax and told them about it they said they will contact copart and call me back about 1 hour later they called back telling me they spoke to copart and said they will take the car off auction and send it back to me they didn't they sold  my car my car is now back on the road someone bought it i wanted it back its still my car i have the logbook mot etc with me

    Why did you call the AA if your Motor insurance was with the broker Geoffrey?

    Accident Exchange (AX) are not an insurance company but a credit hire/accident management company. They deal with your claim on a credit basis and then attempt to recover their outlay from the third party's insurance company (TPI). In the event of repairs they pay for the repairs on credit and reclaim the cost but for total losses they commission an engineers report which is sent to the TPI and the TPI pays out on the total loss.

    Normally the engineer's report would say the car was worth £1,600 and the salvage is worth £200 and so the TPI would send a cheque for £1,400 given that they arent receiving the salvage. Normally thats the end of it but seems that AX have an arrangement with CoPart (who are well known) who have come up with their own value for the salvage. 

    Were you aware that the £210.99 was just the salvage value and not the whole value? I'm assuming you've just miskeyed and so the total offer is £1,610.99 if you dont keep the car or £1,420 if you do keep the salvage?

    What outcome do you want? Clearly CoPart should reissue the £210.99 so you have the total of £1,610.99 that the engineer commissioned in your name valued the car at.

    You should always have the car recovered to home if at all possible especially older cars, it doesn't take much to write off cars these days, which can be repaired fairly easily with second hand parts.

    i was  aware that the £210.99 was just the salvage but refused it as i wanted the car back so i could fix it myself just a bumper and headlight  the car is back on the road someone bought it from copart even thou i kept telling ax i wanted the car back the other party's ins company had no interest in my car so i could do what i want with it. that's what ax tell me i wanted it back for weeks i was telling  ax i want it back but they authorised copart to sell it on the 11/12/24 even thou i wanted it back  i phoned ax they are investigating they told me they was a clerical error on there side and i should have had back

    even thou the car has been sold I'm sure its still my car as i refused any money from the salvage company i have all the paperwork log book mot etc  also ax have told me they are at fault due to a clerical error  would it be worth me taking ax to a small claims court if they don't compensate me

    You have the pre-collision value of the car.

    You were told that you could keep the car, but it's no longer available. No deduction was made from your payout, so there's no financial value associated with it.

    The best you can really hope for is an ex-gratia goodwill payment, but it won't be large, because everybody involved there was no great value in the car. Perhaps around scrap value.

    You were offered the chance to keep your car for the scrap value of £210.99 and you refused the offer so they sold it?

    So you are owed that £210.99.

    Yes, that's how a write-off works. The insurer buys the car off you for its value. You can, sometimes, opt to effectively buy it back by giving up some of the payout in return for retaining the salvage, but there is no right to do so.

    Here, you have been offered that but circumstances prevent it.

    Was the pre-accident value £1420 or £1630.99? If its the latter, and you've been paid £1420 and the promise of the car back, then they owe you £210.99.

    In theory, since you didn't give them the V5 (you didn't, did you???) then Copart have unlawfully registered the car into the trade. And if its sold without the V5, then the subsequent owner who tries to re-apply for it will have the barrier that its not lawfully Copart's to sell on. But all that doesn't really help get the car back.
