Note - the cap park has recently improved its enternance signs ( still no signs are the part i parked in ) i suspect this is to help them win more claim. But the fact they still havent signed the part is used, tell me they make a !!!!!! tonne of money from this 'pull in bay'.3. The Defendant denies that the Claimant is entitled to the sum claimed, or any sum at all. The Defendant provides photographic evidence dated 14 January 2025 showing that, there were no visible signs or ground markings indicating that parking was prohibited or that the area was not a designated space. The Defendant parked in good faith and was given no clear indication that parking was restricted. Accordingly, no contractual breach occurred, no loss was suffered, and the Claimant has no cause of action. The bringing of this claim despite evident deficiencies in signage and markings amounts to unreasonable and abusive conduct.

Evidence is for the Witness Statement stage, although unlikely to get that far. Instead I'd say:
3. The Defendant denies that the Claimant is entitled to the sum claimed, or any sum at all. The Defendant parked in good faith in a lay-by style area that invited parking, and no instructions, road markings or lines to the contrary were present and absolutely no signage existed. Accordingly, no contract ever existed, therefore no contractual breach occurred, no loss was suffered, and the Claimant has no cause of action.
The Defendant notes that since this event the Claimant HAS erected a new sign in the area.

Should I do it on MCOL or email ?

The DEFENCE ( no S ) should be copied and pasted into MCOL, and save. Submit when ready
We stopped advising people to use email back in July 2025
No offence occurred, ( no S either ) just an alleged breach of the parking contract on that private property

1. DCBL sent a copy of my defence to me
2. DCBL sent their N180 to me
3. I have just emailed my N180 to DQ & DCBL info@ and had automated responses.3 -
Hi,
I've had recently had 3 parking charges at the same spot in Doncaster and looking for assistance.
That lay by is really misleading isn't it!
Before discovering this site I just threw away the first NTK, and I have since received 3 dcbl letters and just got my fist LoC from dcblegal today!
I know that I will be directed to the newbies thread, I've looked at it alot and it is all a bit confusing and overwhelming.
Could you advise me how to proceed and update how your situation has gone please?
