Afternoon - it's been a while....  My son has been contacted by DCB legal several times over the phone since my last post, with them offering to reduce the sum claimed.  He has stated each time that he is willing to go to court.  Today (4th August) he received this letter in the post.  Looks like it's time to get all defence information together.  As this has to be given to DCB legal also is it worth submitting this information as late as possible?

    Many thanks

It is the witness statement and evidence that needs to be pulled together, the claimant already has your defence.

Would you know when they are they likely to discontinue? It will take time to pull together defence etc so don't want to do this if they are likely to discontinue soon!

Its likely to be near the hearing fee date shown on the court order,  but you haven't disclosed that date, just 2 pieces of paper with different issue dates on show  ( May and July  , the July one has the claim reference on show too )

If you want reassurance,  look at the other 620 or more discontinuations in the thread by Umkomaas

You definitely will not be pulling together a defence,  the defence was filed months ago

    It's not defence stage.

But we'll see you in a couple of weeks to do the Public Consultation (...please) while your case is quiet.

You can find that thread without a link.

Please bookmark it (the one about the Consultation) & come back as we need another week or so to think about our 'recommended' responses to the Consultation a bit more (what we won't do is provide a template, for obvious reasons).

Hi Gr1pr - the paperwork I have shown is all that was received yesterday - I too thought it was strange about the dates.  It says the court date will be after 3 October but all documents which are to be relied on in court must be submitted by 4 pm on 22 August.

It should also state when the hearing fee must be paid,  so I suspect that the court has added the wrong second page, or perhaps its a hearing on papers  ? But the first page allocated 90 minutes,  so to me it's a paperwork error

I suggest that you phone the court and query it due to the missing £27 fee,  missing deadline etc, and as you say the actual hearing date is currently unknown too

Perhaps once the paperwork is in they will issue a directions order containing the missing information

But the WS bundle deadline is mentioned so it must be submitted by both sides to both parties by that deadline date this month, the 22nd,  so you need to get on with that task, unless they discontinue beforehand  ( you don't have a choice at the moment,  so you have 2 weeks to get it drafted  )
