I was thinking surely the level or stress would be just cause for appeal as capability to enter into contract was impaired. Their website has not been transparent and their faq is not accessible through normal means. Even looking atthat retrospectively from a google search doesnt advise to submit anything which may have impaired judgement.1 -
To be clear: I don't want you to pay anything. In fact I take back my reply as written above because if you know anything about me on here, you'll know that I personally would NOT pay!
I posted a bit 'on the hop' and tried to answer your question about POPLA. And ECP are following the Code of Practice (not that I agree with the £20 and nor does the Government).
Yes they are very litigious now but always use DCB Legal and they always discontinue before hearings. So you will never have a court hearing but will likely get a claim form which could come at a busy time, hence why I said paying £20 might be something to consider.PRIVATE 'PCN'? I feel this charge is a penalty more than an admin charge. I paid the fee set and with all good intent followed what i felt were the terms of parking. Obviously due to stress on the day i have mistyped my cars plate and not the wives and thought nothing of it until i received the pcn 30 days later. To add insult to injury they have seeked administrating a penalty at the bpa maximum onto me despite proving paying. Now if it was £5 or £10 at a push id agree admin charge but i doubt they have spent more than 5 minutes (£4 at £50 p/hr) and £2 on postage fees.
I kind of feel as a matter of principal i dont owe them anything i am concerned about credit report impact however.1 -
you have to go all the way to court and with DCBlegal that not likely to happen ... you have to loose in court and then refuse to pay before you can get a CCJ / credit impact

i am concerned about credit report impact however.Nobody defending a claim here risks their credit rating. Not even if you had a hearing (which you won't) and lost (which you won't).

So what are recommended steps? Forms? Information i should hold close to chest rather than divulge? Ill not pay the £20, i think ill submit to popla on a thi hope they might actually work for the people, then go down guessing claim / threat route0 -
The recommended steps are all where you'd expect (POPLA is there too) in the NEWBIES FAQS thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello, I’m sharing my personal experience with St Wilfred’s Car Park in Preston.I’ve had issues with this car park before. As have multiple people if you check the reviews on Google and Parkopedia. The ticket machine didn’t print out my whole reg on my ticket, despite me checking on the screen prior to print.
I retained the ticket as I knew this would come back to bite me.
They rejected all appeals despite showing proof of the ticket and bank statements to prove that I had paid for that day.
They threatened me with court.
They had people call me (bombarded
me with calls) to try and negotiate a price, which I refused to accept liability for. The responsibility as a faulty machine is not my fault.
They had to pay a court fee for small claims by June for a court date in July.
They didn’t pay the court fee and my case was dropped.
My mum has just today, received a charge for £170 for St Wilfred’s without prior notice or initial CPN. It states a date, no photographic evidence and states that “The PandD/Permit did not cover the date and time of parking.”
She has gone back and checked her statements to double check and she has a transaction for the car park that left her account the day after the date they have stated in the claim.Nowhere on the claim have they stated the timeframe that was exceeded, if there was one!If you take a look at the reviews, so many people have been stung by this particular Eurocarpark. And many CPN’s seem to be really unfair, if true and not the drivers fault. Similar stories about the ticket machine not working or being accused of overstaying when they actually haven’t and others being accused of not paying when they have bank statements to prove otherwise.2 -
@mavisenderby123 you'll need your own new thread about this one (and ask the forum team to let you change your username of it is your own name):My mum has just today, received a charge for £170 for St Wilfred’s without prior notice or initial CPN.
That's usually because the keeper omitted to update their logbook, back when they moved house. A very common but big oversight.
