Hello
I had a PCN from RCP Parking Limited and the fine was £40 pound. I ignored the letter and now it has been passed to a company called Trace Debt Recovery.
They are wanting £170 pound now. Does anyone know if this company can take me to court? I have ignored the letters. But getting quite scared now should I pay or should I carry on ignoring them?

No they ( debt collectors ) can't, but RCP Parking can sue you in court
Do not pay
Check that your V5c is up to date and inform the DPO at RCP of your current address if you moved ( because Trace appear to have traced you ) no old addresses2 -
Sit tight. Do nothing except the below.
By going confidently into the 'ignore' stance, the only steps to take are:
- Tell them if you move house within 6 years.
- Ignore the tedious £170 threatograms shown in pictures in the 4th post of the NEWBIES thread. Did you miss the pics of Trace and other letters already there in the thread?
- Come back if you get a solicitor's LBC as per the 2nd post of the NEWBIES thread. Could be from Moorside Legal, whose claims are laughably badly pleaded.
Nobody pays a penny and no hearing is even needed in most cases. Search the forum and read a few cases as they are easy to beat by waiting for a claim form - it is easier than appealing!
There is no risk AT ALL in defending a court claim. No CCJ. No bailiffs.

Thank you so much for this information. I was going to pay but RCP have passed the debt to Trace Debt Recovery. What a huge difference between £40 to £1701

The original NTK PCN is probably a lot more than £40, we need to see a redacted copy of it, or a picture of the signs
Usually its £100 reduced by £40 to £60 for early payment , non payment puts it back to its full £100 charge
The debt collectors then add an extra £70 onto the £100, making the £170 demanded ( do not pay it )
Ignore Trace recovery, they trace people as well as demanding money, its not a debt unless a judge says so2 -
It isn't a fine it's a speculative invoice, and you don't have a debt only an alleged one Trace can't do diddly squat.

I have had another letter from trace recovery. They have said that if I don't pay in 2 weeks they will pass it onto a solicitor and I could end up with a County Court Jugement.
Please advise as I'm getting quite worried now.
