I'm going to OHaras next week to do d out where our money has gone and are criminal charges been sought. I've wrote to my MP, contacted the local press and also Rip off Britain for help. I'm not gonna let this go without a fight. I know our money is gone but whoever wasted it better get charged.0

Can I ask if when you bought your plan - were you told at the time that your money would be held in a trust that basically no one could touch? I'm not sure. It's so long ago. We bought it, had one email then nothing. I only found out by accident that they had folded. I'd been paying for months after they ceased trading with no word from them!!! Furious!!!0

Today I received cheques from Dignity who took over from Empathy. I had said I wanted to cancel WHEN I knew how much I was going to get. I paid over £6000 to Empathy for my husbands and my funerals and received £148 each as they say they never received funds from Empathy. Any advice please as to how we get our money back. Really upset by this as thought I was doing the right thing by saving my children future worry. It needs to go public0

When companies go bust, unsecured creditors, if they are lucky, get back pennies in the pounds. Once the company have been liquidated and the available monies have been distributed there is nothing more you can do.lisacrisp said:Today I received cheques from Dignity who took over from Empathy. When a company goes bust it usually means its debts exceed its assets. The liquidator pays the creditors from whatever assets the company has (which are usually very little). As an unsecured creditor you have been paid the amount you are due, there is no big pot of creditors' money hidden under the floorboards.lisacrisp said:Is there really NOTHING we can do about these thieves ? The problem I have with the approach is that I disagree that funds paid to the company, went to the company. They were supposed to go into a separate Trust, independent of the funeral plan provider. That's what we were told - and that's what all the all providers were also spinning at the time pre-regulation. If that turned out to be a lie, and money was never sent to a trust (and hence Dignity never got it) - isn't that essentially fraud?lincroft1710 said:
