Euro Car Parks: Notice of Proposed Allocation to the small Claims Track questionnaire to fill out


My apologies, first time poster. I have used MSE many times for help, and have looked for information on how to complete this form, but I'm full of flu and totally lost.
I received the letter on Saturday 4 January, but it was posted on 24 December and asking me to respond by 10 January. I couldn't call them yesterday due to work and caring commitments, but I'm currently on hold (position 19) to ask for an extension given the delay in the postal service over the Christmas period.
In October 2020 I parked in a Euro Car Park and their ticket machines weren't working (I took pictures) and then their mobile site wasn't accepting the car park code (I took a screenshot). I disputed the ticket at the time, within 14 days, and never heard anything until they had passed the debt on to a debt collection agency. When I go the notice of intention to take me to court (after I'd responded consistently to the various people who contacted me about this) I filed a defence which stated I would pay some of the fine, but not all, because legally I didn't have a ticket, but I wasn't told my dispute hadn't been accepted, and if I had, I would have paid the original charge of £50 (begrudgingly). Defence filed copied below:
On 8 October 2020 I visited Bolton for an appointment, and I parked on Kay Street car park. I’m not familiar with the area, so arrived at 15:34 for an appointment at 16:00 which my maps app said was about a 10-minute walk from the car park. I tried to pay for parking at both parking machines, but the machines were not working. I then tried to pay using the PayByPhone app, but the location was not recognised on the website. I have photographs of the machines not working (item 1 and 2), and a screenshot of the website not working (item 3). After spending time trying to pay, I was going to be late for my appointment, which I’d paid a deposit for, so I left £2 on my windscreen with a note to say the machines weren’t working, in case a parking attendant checked my car. I left the car park at 16:44.
When I received the PCN from Euro Car Parks asking for £100, or £50 if paid within 14 days, I appealed the notice on the grounds that there wasn’t any way to pay. I provided the evidence (pictures attached) and awaited a response. I didn’t hear anything at all about this until ‘Debt Recovery Plus’ sent me a letter asking for £170 on 11 March 2021, nearly 18 months after I had appealed the ticket.
This has since been passed from Debt Recover Plus to QDR Solicitors, to DCBL Bailiffs, to DCBL Legal, and now to HM Courts and Tribunals Service. I’ve tried to contact Euro Car Parks, but they will not respond to me about this. I’ve regularly contacted the different agencies this has been passed to, with no response, and have had to chase them for replies to my emails. I have dozens of emails and letters I’m happy to share, but I have attached a printed copy of the most recent thread which draws most of the information together, for ease (item 4)
On 3 October 2024, Rachael Mayfield of DCBL Bailiffs emailed me copies of letters which she claims were sent to me. These were a ‘final notice’ letter (item 5), dated 12 November 2020, and a ‘rejection of appeal’ (item 6) letter dated 17 December 2020. I never received these letters, and it doesn’t make sense that I would receive a ‘final notice letter’ before a ‘rejection of appeal’ letter.
Since I was not notified my appeal had been rejected, I think it would be reasonable for me to pay the original, reduced amount of £50 because I appealed the ticket within 14 days, but I can no longer access the Euro Car Park website to access evidence of my appeal. Luckily, the copy of the ‘rejection of appeal’ (item 6), dated 17 December 2020 which I was emailed on 3 October 2024 does evidence that I appealed the ticket though. Regardless of this, I agree, I did not have a ticket at the time I parked, so I’m willing to pay the original fine amount of £100. I believe that I don’t owe the claimed £314 because at the time of parking, I did all that I could reasonably do to pay for the ticket, but the facilities weren’t working.
For information only, I requested a Freedom of Information and Subject Access request for information regarding the number of tickets issues at that car park on that day, and my request was declined.

I'm sick of this, I'm not well, I'm providing end of life care to a loved one, and just generally so stressed, skint and run down. How it can be £314 for a parking ticket which was 70p is totally obscene.

You will be submitting your Witness Statement bundle, including exhibits, to your local civil court later this year, so can rescue your case then0

Thanks Coupon-mad! I was reading the Bagpole guidance and then realised the process changed so now everyone has to accept mediation. I've managed to complete the form and send via email, so now I wait! In the meantime, DCBL have contact me via email to "discuss without prejudice" which I have ignored. Thank you all for your help! I'll update this thread in the future.3
