Euro Car Parks: Notice of Proposed Allocation to the small Claims Track questionnaire to fill out

Hi @Coupon-mad
Thank you for your help. I emailed my defence (I have emailed multiple times before this to ask questions and chased lots with limited response) and on Friday I got a 'Judgement for Claimant'. I took Monday off work to go to the court to see if I could speak to someone, but nobody would speak to me. I finally got a reply to an email yesterday which says I need to appeal to the court, pay a fee (it doesn't say how much) and complete an N244. Is there any information on this site which can help me to complete this form please?
Also, I got the letter below on Friday, even though it's dated 28 April, and I got a chasing letter yesterday also dated 28 April! Nothing tells me any deadlines or even how to 'apply to the court office.' I'm due to renew my mortgage in August, at this point, do I just pay it? The court has made an admin error and it's completely screwed me over here. I thought I had a reasonable case before.
Does it even make sense that they ask when I'm unavailable in the DQ, but then asked me to file my defence, even though I already had filed this during the exact period I informed them I was out of the country?
Does a Judgment for Claimant mean that I have a CCJ now?
Thank you0 -
Does a Judgment for Claimant mean that I have a CCJ now?Yes.
You'll either have to pay it this month to make it disappear or apply this week to set aside this latest Order. Applying is begging the court to reverse the decision and is not guaranteed; it would be considered by a judge.
It will cost £129 fee to apply to set aside the Order, attaching (signed & dated under a statement of truth) a Witness Statement explaining the full chronology that you told us (your blow by blow account of what went wrong, attaching both your defence and your N180 showing the dates you'd already told the court you were abroad) and concluding that:
There was nothing more that I could have done and considering the Overriding Objective and the principles in Denton, the Order dated 28th April 2025 should be set aside.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you for the help. I don't have the energy to deal with this anymore. I have to renew my mortgage soon and can't risk this messing that up. I've paid it.
I have also put in a complaint with HMCTS regarding the admin error, as I think I otherwise had a good case.
I'll report Euro Car Parks to the British Parking Association too.
Thank you for all of your help, I really appreciate it. I'm sorry I had to give up2 -

I think they should cover a couple of hundred quid of this, especially as DCB Legal/ECP cases (single PCNs) are an abuse: ALWAYS DISCONTINUED and never seen to reach hearings, which is a national scandal flying right under the noses of the court service.
How dare they do this to you.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I still wouldn't give up. Post a complaint pack to Judge Mitchell.
Judges can order whatever they like pretty much, so you never know what might happen.2
