I bought a Dyson Airwrap in October from Ebay from a trusted seller. I received the item worked perfect did had box with serial number all the parts nothing to show its not real. I was able to register the Item on the Dyson website for a guarantee so I never suspected it at all this point to be fake. In December I found that the attachments were not sticking to the wand so well so I contacted Dyson they arranged for a repair under the guarantee. Now A few days letter I received an email from Dyson to say the item is counterfeit and they will not be sending it back and if I show the letter sent to the retailer I bout it from they should refund me. I have taken this to Ebay but they are refusing to refund as its out of the 30day Money back guarantee. I am really fustrated and annoyed as this should be covered by eBay or dyson as they registered the item as real on the website that means dyson is a scam aswell.
Can anbody help as I should be able to get a refund. As i took the right steps to authenticate that it was real.
Thanks
Your complaint and your consumer rights reside with the seller. Get in touch with the seller, tell them what's happened and send them a copy of the letter. See what they say and come back for advice if you need it.
So now you are left with the seller direct. Where is the sellers business based?
If it's a uk based business then do you have their company name or address?
the seller is wrong, you rights in law are not limited to 30 days if there is fraud.
To this being a counterfeit eBay should be refunding me they keep just saying about the 30day money back guarantee being over1 -

eBay are not responsible for refunding you, it is not their responsibility as they did not sell you the item.
It won't be much use for a Chinese seller.
There are Chinese sellers despatching from the UK
This one does sound pretty sophisticated if the model number got registered.

eBay are not responsible for refunding you, it is not their responsibility as they did not sell you the item.
All my invoices are from ebay (uk ltd).
If I click on a seller and then "about" I get something like
location: china
member since: Jul 2018
A seller that's been removed won't even have that.

But do you not technically pay Ebay? and then the seller fulfils the order ? and then ebay sends the balance minus their fees ?0

The below is quoted from ebay terms and conditions
#############################################################################
eBay is a marketplace that allows users to offer, sell and buy just about anything in a variety of pricing formats and locations.
eBay is not involved in the actual transaction between buyers and sellers. The contract for the sale is directly between buyer and seller. eBay is not a party to the transaction and is not a traditional auctioneer. Unless through limited programmes such as eBay Authenticity Guarantee, eBay does not have possession of anything listed or sold through eBay.

So when exactly was the item purchased.
Either ebay account or paypal should show retailers details.
Although I expect this will be a non UK company, so you may have no UK consumer rights anyway.Life in the slow lane0 -
ebay invoices do not show seller details for me. It says it's from ebay (uk) ltd and gives a london address.
paypal payments are made to ebay not the seller AFAIK but I use credit cards.
My credit card transactions are made to ebay.
seems to be a great place to hide

As a Dyson Airwrap retails at about £450 then it should have been quite obvious that this was a counterfeit at only £300. Even refurbished ones sell for about £360!
Did you get any separate emails from the seller regarding dispatch etc...? They might have the actual sellers contact details on. When purchasing, did you look closely at the seller's details and check it was a UK address? How long had they been selling on eBay?
It's likely the seller has used the same serial number for several Airwraps, and you were the first to register it with that number (Iots of people forget or don't bother). Someone else then no doubt tried to register and then realised it was already registered, the scam was uncovered and eBay got rid of the seller.
Essentially, the seller has now gone "bust" so is no longer trading, so no claim against them.
Your only hope is to be super nice to Dyson and see if they have a refurbished one they could sell you at a sensible price. They don't owe you anything though as although you say you used due diligence, the very low price should have been a red flag.
On the plus side, at least they didn't catch fire or anything!Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)1 -
# devils advocate for challenging purposesWhy would Dyson help someone who buys cheap fakes of their product.
most reasonable people seem to think it’s eye wateringly obvious.
It’s not an accident it’s a choice to not support the business and support the scammers.
i wonder how sympathetic a judge would be.
there may be genuine cases when things are sold off cheap e.g. fashion is sold off cheap when it’s out of season/ off trend but every grown up knows that stuff doesn’t “fall off the back of a lorry”.0
