Private parking has sent me to court

Hello how is everyone doing.

Civil enforcement limited has sent me to small claims court and I had filled out my defence saying I was not the one driving the car at the time.

I now received another letter saying they want to continue and I have to fill out a N180 form. Just want a draft on what I can write so I don’t have to pay out this ridiculous money they say I’m liable for

Too late to write anything at the N180 stage

Follow the 12 steps in the defence template thread plus in post 2 of the newbies sticky thread in announcements,  downloading the N180 and complete it and email it to the lawyers If used,  or to CEL if no lawyers are involved,  plus to the DQ email address at the CNBC,  following the court process

Not being the driver is not a defence to the court claim,  or extremely unlikely to matter

CEL and any lawyers will say, your vehicle so your responsibility

Oh dear ... why did you do a weak defence before coming here?

Surely you wrote more than that?  Not being the driver isn't a valid defence.  Please show us your actual defence, verbatim.

I was clueless and didn’t know what to write, I had found out about this website after I wrote the defence and knew I had made a major mistake. If I am forced to pay then I will have to maybe the N180 form is the last saving hope

There is a long way to go after you fill out an N180

Follow the advice in the 2nd post in the newbies sticky thread in announcements by coupon mad,  plus the 12 steps in the defence template thread

Any court hearing is several months away,  after the witness statement bundle stage,  dealing with your local nominated civil court

You are not forced to pay & should not offer anything. N180 is a nothing stage.

We want to help you at Witness Statement stage. Please show us your actual defence, verbatim.

    Oh dear. That was inadvisable.

It wasn't a fine, parking charges are contract law invoices and 'not being the driver' isn't a valid defence unless this was at a Port.

Why is it £500? Two PCNs?

    Where exactly?

Can you collect evidence of the signs?

Show us pics of the terms on the signs and also show us the Particulars of Claim. Cover your VRM.

Suggest you file a defence-witness statement hybrid when you get to that stage.

I'd prepare now by going to the thread with the standard defence on it and convert it from third person to first person where applicable.

    1. How do I collect evidence of the signs?

    2. Is there any way online or ?

    3. Also do I have to fill out the n180 form by the date required ?
    1. Revisit the car park and take photos

    2. Google Street View (possibly)

    3. Absolutely you do - see the 12 steps in the Defence Template Announcement.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
