Excel Parking PCN - How should I appeal?

I got a PCN from Excel Parking while I was at the pay machine buying my parking ticket (Pay and display car park), I have my ticket and receipt which is timestampped at 14:08 and image of my car on the PCN is taken at 14:09.

I appealed to them showing images of the parking ticket bought and the receipt, the timing of the picture taken of the car and that it takes a minute to get down from the pay machine to the car as the pay machine was 2 levels from where I parked the car, the only pay machine in the car park. 

They've rejected the appeal, reduced the charge from £40 to £20 or to appeal with IAS. 

Their reply:
'Thank you for your recent correspondence.

The terms and conditions of the car park are displayed on signage in prominent locations thoughout the car park.  Any vehicle found to breach these terms and conditions will be subject to a Contractual Parking Charge Notice.  Photographic evidence of the breach of contractual term is avaliable by request.

There are sufficient signs at the entrance to and in prominent locations throughout the car park displaying the terms and conditions. You are welcome to revisit the site to view the signage, we advise you to adhere to the terms and conditions of parking when you are visiting the site.

Our signage complies with the International Parking Community's Code of Practice.

Due to the circumstances raised in your appeal, we have reduced your parking charge to £20.00.  This offer of a reduced settlement only applies to the first Contractual Parking Charge and is valid for 14 days starting from today. '


I just can't understand why they would not accept the appeal when I have clear photographic evidence of parking ticket being bought, their reply just seems generic. 

I've read on this forum that IAS appeals are not as successful as POPLA, has anyone got any templates on how to write up a good IAS appeal, what other points to include?

    Private parking companies reject appeals simply because there is no profit in accepting it   its driven by greed , not compassion or common sense 

    Do not appeal further,  that would generate more disappointment,  they are the opposition,  not interested in cancellations

    There are no templates,  there are no winning words 

    File away and ignore them 

    Court is where you can win, via an independent judge

    Or a discontinuation - many parking companies shy away from court when they realise their bully boy tactics are not going to work and cancel at the last minute leaving you with nothing to pay.

    Ignore the scamming dimwits if the Muppets chanced court I am sure a judge would see through them with this evidence:
     I have my ticket and receipt which is timestampped at 14:08 and image of my car on the PCN is taken at 14:09.

    Notice they have not addressed your appeal evidence at all but have made a reduced offer, a clear sign they are on a sticky wicket.
    What exactly was their scam reason on the NTK for issuing it anyway?

    "Term breached: Parking without a displaying valid Permit or Authority"

    I assume whoever was working for them was just walking around at that time, saw a car without the ticket displayed and just took a picture and then not verified if it had a ticket displayed later 
  • They're definitely trying to extort what they can, original parking charge amount £100, reduced to £60 (correction from 40 I initially said) if paid within 14 days and now reduced to £20 if paid within 14 days

    But yea I'll fight it

    I might do too. A relative I was helping decided to do that this year
