I think the C word has a lot to answer for - AIUI the Montreal Convention was written on the basis of reimbursing likely costs, i.e. a primarily damages-based regime, whereas the later EC261 regulations introduced the concept of fixed-tariff compensation, as a separate entity from reimbursement of costs, sometimes leading to a wider expectation that inconvenience in itself should be recognised financially beyond the scope of EC/UK261.zagfles said:
