I spoke to a barrister about this situation and she said I need to prove that they didn’t lose anything.Your barrister lady seems to have missed the Beavis case in the Supreme Court. Perhaps been asleep for the past 9 years! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The claimant has to prove their case in court, the defendant doesn't have to prove anything
Court is a lottery, unpredictable, so no speculation
Lastly?..... definitely not, no contact until the compulsory mediation stage in the future

coolguyMD said:Thank you all for ur help. I recently used one of these online legal help websites. I spoke to a barrister about this situation and she said I need to prove that they didn’t lose anything. Since I did pay to park there but just selected the wrong car park on the app, I need to show that they manage both car parks as this way they still got paid. However I just called Excel parking services and they say they don’t manage the car park that I did pay to stay in.So what does this mean for my case, do I have no defence if this goes to court?
Lastly, I’m thinking of calling DCBL or Excel and telling them that I DID try to pay for the PCN but the transaction declined on their website multiple times and I couldn’t pay the £60. I have screenshots of the failed transaction too. Is this advisable?
The legal help websites are not parking law experts. We are.
You simply ignore ALL the Direct Collection Bailiffs Ltd letters and come back to re-read the 2nd post of the NEWBIES thread when you get a DCB Legal letter. It's really simple.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

i honestly do not understand the mindset of wanting to call these firms3

Just want some confirmation that I’m about to do the right thing, and some help with wording my email.
“Your Ref. …
Proposed Legal Proceedings
Claimant: Excel Parking Services Limited
I refer to your your letter of claim.
I confirm that my address for service for the time being - assuming you don't faff about and delay any claim - is as follows:…
The alleged debt is disputed and any court proceedings will be vigorously defended.
I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').
My reasons for defending this claim are as follows: I had already attempted to pay both PCNs within 14 days of them being issued however even after trying to pay several times on the website your client directed me to all the transaction were declined. I have screenshots of these failed transactions. After this event the 14 day discount had ended….
I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".
Don't send me your usual blather about that.
I have two questions, and under the PAP I am entitled to specific answers:
1. Am I to understand that the additional £70 represents what you lot dress up as a 'Debt Recovery' fee, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?
2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?”
Firstly, am I sending this to the email on the top right of the DCBLegal letter (info@dcblegal.co.uk)?
Secondly, id appreciate some help wording my reasons for defending the claim: “My reasons for defending this claim are as follows: I had already attempted to pay both PCNs within 14 days of them being issued however even after trying to pay several times on the website your client directed me to all the transaction were declined. I have screenshots of these failed transactions. After this event the 14 day discount had ended….”
Can I say that it’s not my responsibility to try to pay them again since it didn’t work the first time? Should I attach the screenshots I have of the failed payment attempts? Could saying that I DID pay for parking however I simply paid for the wrong car park on the app be a legitimate reason?

Is there any particular reason why you intend to admit liability?
Leave out the stuff about previously trying to pay. You don't need to give a reason just yet, just state you deny the allegations.
Have you exhausted Plan A yet, a complaint to the landowner and your MP?.
Where did the alleged events occur? They may have cropped up here before.

What do you mean by admitting liability, which part of the email is doing that?
Im only including a defence like that as this is a template email I copied from the newbies thread and they also stated that I could include reasons for defending the claim if I wished.
Lastly, no I haven’t tried emailing the land owner, it’s not a retail car park or hospital etc so didn’t think I’d have much luck. Also I didn’t know how to get hold of the land owners details. It’s just a private car park in Lace Market Nottingham (high pavement street).
the pcns were issued as I did not pay for parking. I thought I had I just mistakenly selected the wrong car park in the app.1
