    Is this what is expected?  I would have liked something with a bit more confirmation like "Thank you, we have received your defence for claim xxxx and will process this"


    Any clarification is appreciated.

  • Hi All,

    A quick update.  My Defence was received by MCOL on the 23/12.  Today I have received a letter from DBC Legal saying their client intends to proceed with the claim, letter is dated the 20th - exactly 28 days after receiving the defence... Nothing has been updated on MCOL portal.

    It went onto say:
    "The Court will direct both parties to file directions questionnaires in due course.  In anticipation of that we are enclosing a copy". 

    It has also said they would be willing to settle and to call their number.  In their questionnaire they have agreed to  small claims mediation service.

    Do I sit and wait to hear from the court?

    Items 8, 9 and 10 on that list are what to do next.  In the Template Defence thread.

    This case is slowly progressing.  I've had mediation, it took 5mins and the guy on the phone was very helpful, supportive and offered some advice if/when it goes to court.  Fine is £300, DCB legal said they would be happy to reduce it to £260 at mediation but I refused to pay them anything.

    I was expecting it to be thrown out but I have now received Notice of Transfer to Proceedings.  Is this a normal next step or does it mean I definitely get my time in court to defend it?

    All normal,  but should have lasted 5 minutes,  not 30 minutes 

    Mediation is about reaching a compromise agreement at a certain figure,  agreed by both parties,  or not 

    Definitely nothing to do with the case and definitely not thrown out either 

    No it does NOT mean it's definitely going to a court hearing,  only to the next steps in the 12 steps,  like this example

    Just a quick update on my ECP/DCB claim, Court case is set for June.  I received this email today (see below in italics, I've removed sensitive data):

    I think the original sum on the claim for was for £300.52, they agreed to drop to £260 at mediation.  Now they claim it it stands at £350.40.  I'm not going to pay it and quite keen to seem them in court but curious how to respond.  

    Should I just ignore - it could actually just be a phishing email and not related to DCB at all!?

    Any helpful advice will be gratefully received.

    We write to you in relation to the above matter.

    To assist the Court in achieving its overriding objective, our Client may be prepared to settle this case. I can confirm our Client would be agreeable to £80.00 in full and final settlement of this Claim. The current outstanding balance is £350.40.

    Should you be agreeable to this offer, please confirm the same within seven days. Payment can be made via our website www.dcblegal.co.uk/response/pay-online/, by calling our office on 0203 838 7038 or via bank transfer using the details below:

    Morning All,

    Some good news received yesterday.  On the last day for the court fee to be paid, Euro Car Parks filed a notice of discontinuance.

    They really should have some sort of penalty, their case would have reserved court space/time and they never had the intention of pursuing.  They've also wasted 4 years of my time.

    Can we write to our MPs or something to try and address this?

    Many thanks for all the help received from this forum, I'm not sure what I would've done without the advice.  I appreciate the advice on here is free and it is an excellent resource.  I will be sure to pass on all my knowledge to whoever asks.
