Horizon Parking PCN - final reminder letter with no previous letters

Hi,
this is my first post and i am literally a newbie. i have gone through the beginners guide but unable to find the answer to my issue, please, any help is welcome. 

my vehicle was parked at Tescos in a disabled bay. i recieved a letter in the post which stated it was the final reminder to pay before going to debt recovery agency. 

i wrote a letter to them (no options of ringing or emailing) wiht the following: 

Dear Horizon Parking,

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

There will be no admissions as to who was driving, and no assumptions can be drawn. Since your PCN is a vague template, I require a full explanation of the allegation and full evidence. You must include a close-up actual photograph of the sign that you contend was at the location on the material date, including evidence that it was properly illuminated on the date and time in question, as well as your images of my vehicle showing beyond dispute that it was in the alleged location at the alleged time and date.

There has only been 1 letter received dated 18/10/2024, can you provide evidence that you have sent correspondence prior to this letter, and that the correspondence has been received.

Can you confirm if you are using the Protection of Freedoms Act 2012 (POFA) or NON- Protection of Freedoms Act.

I contest and appeal this ‘parking charge’, on the grounds that you have failed to comply with Schedule 4 of the Protection of Freedoms Act 2012.

I admit to being the registered keeper of the vehicle but “There will be no admissions as to who was driving, and no assumptions can be drawn” as stated above, so I am unsure who it is you will be attempting to recover this payment from.

Under British Parking Association Code of Practice, there is a grace period, visible on signage, can you confirm with photographic evidence that the Grace Period is clearly visible and if you can demonstrate that the Grace Period was allowed by showing exact times the Grace Period took place.

Since then, i have just recieved a follow up letter from them stating that they have issued the PCN to the keeper/driver and have written subsequent letters. the time period has lapsed to complain and therefore it has now transfered to their debt recovery agent.        

what do i do, what can i do? any help is welcome. 

i was thinking of taking a trip to the tescos and taking photos of the signage to see if the signage has issues? but not sure at this stage if is beyond that i.e if Horizon Parking pursue to court

    That's a good idea.
    Go to the Customer Services desk, show them your receipt for the shopping on that day, show them your blue badge, show them your Clubcard and ask them to cancel the parking ticket.
  • thank you for your prompt reply Keith - i was wondering in terms of the final letter bing sent without previous initial letters to notfy me. there was no ticket left on the car but a final reminder letter months later. 

    i did request that they provide evidence of the previos letters sent and delivered but they ignored this request. 

    i'm not sure if this is a tactic used by these companies when they fail to send correspondance.

    Horizon will say that they did send an earlier PCN - it must've got lost in the post.

    Have you already done what I suggested earlier?

    sorry missed the first line of your post - I have requested they provide proof they sent and the correspondance was delivered - if it goes to court surely they will need to provide evidence for this.

    Because it seems the simplest way.
    Asking the landholder to intervene is seen as 'plan A' and especially at that type of site the supermarkets are usually keen to retain their customers.

    Your idea of visiting the site and taking pictures of the current signs is a good one and will come in handy if this gets to court.

  • nevertheless, i will go tomorrow and speak with customer services with the blue badge. many thanks for the suggestion. i really hope it hasnt gone beyond the point of no return.

    It was a serious suggestion.
    I can think of one way to overcome that doubt but you seem to be reluctant to even talk to Tesco.
  • youre right, i am reluctant becuase everything ive read online doesnt really fill me iwth confidence. i think its just the climate we live in now where these companies are just ruthless.
