    I have edited the 3rd paragraph and only posted that bit as requested and it is below.

    3. The defendant parked in the car park and purchased a ticket. Before the time was up the defendant came back to the car and moved out of the parking bay and waited safely at the exit of the car park to leave. A shop was preparing an item which the defendant needed to collect and he was nervous of pulling up on a narrow street and blocking the road. At this point the defendant is not in a parking bay or taking up any chargeable space in the car park but just waiting to leave the car park. The defendant then received a PCN based on ANPR entry and exit but which failed to take into account these sets of events in between entering and leaving. If the video evidence is provided it will show these events as true

     In terms of the sticky thread the email address picture was later said to have been changed I thought, which is why I asked for clarification. I have tried to read everything linked. Don't think I am rushing. Just quite a lot of information to take in and process hence I am asking for advice which i thought was the right thing to do. Again in terms of "rushing", just thought I would try and get it done to not miss my deadline as suggested by a few people. respectfully I think you're implying that I am just all over the shop when I am really trying to do my best to appear the opposite!

    You have 3 weeks before the deadline for the defence submission, so you should wait until the middle of December at the earliest, then you have time to study the advice here properly, those email addresses changed after the 28th of February and have been valid since then, definitely not new or recent 

    The 12 steps answer the questions you asked, the first 4 or 5 deal with the current stage of your case 

    So for now you are on draft 2 but you could be on draft 12 before the middle of the month, depending on the feedback. Being all over the shop is par for the course for newbies, nobody here cares as long as you take your time and get it right before your deadline 

    PS , I mentioned that you post ALL of the paragraphs that you have changed 

    You also changed paragraph 2 of the template, so that is a bare minimum of 2 paragraphs to post in this thread going forward

  • Hello. Apologies for delayed response. Got hit with the flu. 

    I have prepared my defence letter as per the above advice, the newbies thread and the tremplate defence thread. Thanks everyone. I have submitted my defence to the email ClaimResponses.CNBC@justice.gov.uk and have had a response to say it is submitted. 

    "Thank you for emailing the Claim Responses Team in the Civil National Business Centre. Please expect a response to your enquiry in 10 days 

    When sending us documents please ensure you comply with the Practice Direction 5B

    File is 55kb and 5 pages long.

    I think that covers the first 6 actions of the 12 point first steps and I now wait for the responses in points 7 and 8. Is that correct? Thanks again for all your help.

    So I am not sure what has happened here but I got this response. I thought I had done everything in the right time. Am I misreading this or have I messed up? Do I need to pay £303 to contest this? Thanks for all your help. Again.

    Thank you for your claim response. 

    I’m returning it as a Judgment (CCJ) has already been entered against you as the defendant failed to submit a response to claim in time. 

    What to do now

    If you dispute the debt and want to remove the CCJ from your credit record, please fill in an N244 Court Application Form completing sections 1,2,3,10 and 11: In Section 3 you should ask for ‘Judgment to be Set Aside’ and give reasons why you don’t agree with it. Please note, an application to set the Judgment aside is not automatically granted and the outcome of it is at the discretion of a Deputy District Judge. 

    Where to find application

    You can download the N244 from www.gov.uk Post three copies or email it to Applications.CNBC@justice.gov.uk

     Fees

    There is a £303.00 court fee to process the application. You should send your cheque or postal order (made payable to HMCTS) together with your N244 to St Katharine’s House 21 – 27 St Katharine’s Street Northampton NN1 2LH. Credit/debit card payment can be made by calling our Helpdesk number Mon - Fri between 9am and 3:15pm.

    Help with Fees

    Log into www.gov.uk/get-help-with-court-fees

    You will be given a Help with Fees, ‘HwF’ reference number which you need to clearly note on your application form.

    When did you file your Defence?
    What is the date of your most recent response from the CNBC?

    Can you please show us your MCOL Claim History.

    I emailed in my defence on Fri 20/12/2024 and they confirmed receipt with: 

    "Thank you for emailing the Claim Responses Team in the Civil National Business Centre. Please expect a response to your enquiry in 10 days"

    Their response posted above came in 02/01 but I only just found it in my junk folder annoyingly.
