First of all sorry for my newbie parking post. I am aware I may get some of this wrong but I have genuinely tried to read all the guidance and started my own thread as instructed. I am really grateful for the advice and help I have already read. My details are vague as suggested in the sticky post. If you want me to post any documents please let me know. Thought I would wait first as they may make me identifiable?

I received a PCN through the post over two years ago. It is hard to remember exactly the process but think from memory I appealed and it was rejected. Effectively I paid for a set time in the car park and before that time was up got into my vehicle and moved out of the space itself but did not leave the car park. From memory my wife had bought something and they needed to load it into the vehicle at the shop and so I waited for them to get it ready. Because I was in the car and not taking up a space I thought this was ok and better than sitting on the street. I was unaware it was ANPR rather than someone checking tickets. I then got a PCN through the post which I appealed and possibly/stupidly gave my name at the time. Can’t remember but I appealed thinking as I was out of the bay and with my car they would accept it if they checked the video. Naive! They rejected it and said the internal process was finished. Then they started to bombard me with letters. At this point I (rightly or wrongly) just ignored them. The amount of letters they sent out must cost them more than the fine! It escalated to debt collection letters and so on but I kept with it. Now I have a “Claim Form”. They have tripled the original fine. I am committed to taking this as far as I need to! They seem like total scammers. 

It is DCB Legal representing the parking firm which I read are likely to not pursue if I keep pushing back. I just want to make sure I follow the correct advice as there is quite a lot for different scenarios and so thought I would ask. This is potentially eating up a lot of my time but it is the principal so I am in for the long haul!

 The advice given is to send this direct to DCB Legal correct? Do I respond to the CNBC at all yet?

Do I file an “Acknoweldgement of Service” with CNBC? It says I have 14 days to do this and I am about halfway into that process time. I want to make sure I cover all my bases even though I have been ignoring them up until now.

All your advice is really gratefully received and I am really sorry to ask!

    Hello and welcome.

    You are past the point of responding to a Letter of Claim. Do not do that.

    What is the Issue Date on your Claim Form?

    Can you please show us a picture of the Particulars of Claim - with all your personal detail hidden of course.

    Who is the Claimant?

    Issue date is 20th November. 

    With a Claim Issue Date of 20th November, you have until Monday 9th December to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 23rd December 2024 to file a Defence.
    That's over three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Same as all the other boilerplate DCB Legal claim forms. You could literally just read two or three like yours and copy what they did.

    It is that easy.

    Its not defence letters to DCB , nothing is going to DCB at the moment 

    Its similar recent cases where you can virtually copy what they used as their defence draft for your own 

    You will be emailing it to the CNBC in Northampton in due course, so you should be studying all the relevant information carefully, especially the replies above

    I have written the following. I have cut and pasted your defence template (THANK YOU @Coupon-mad that is amazing!) and put my own description into paragraph 3. I Will cut and paste it here for reference. Could someone sense check paragraph 3 for me?


    3. I parked in the car park and purchased a ticket. Before my time was up I came back to the car and moved out of my bay and waited safely at the exit of the car park to leave. A shop was preparing an item which we needed to collect and I was nervous of pulling up on a narrow street and blocking the road. At this point I am not in a parking bay or taking up any chargeable space on in the car park but just waiting to leave the car park. I then received a PCN based on ANPR entry and exit but which failed to take into account these sets of events in between entering and leaving. If the video evidence is provided it will show these events as true.      

    Could someone confirm the following for me please? 

    Is it ok to send my defence in now after my AOS today., Think so but just checking. 
    Which email address to send my defence to? Looks like something changed email wise during this thread so just thought I would check
    Do I send anything to DCB Legal as well? 
    Once I have filed my defence am I done until I get  a response?

    Paragraphs should be in the third person, as , the defendant, no personal words like I

    Only post the paragraphs that you have adapted, typically the first few paragraphs in the defence, not the rest of the unchanged template 

    Study the replies in this thread, especially by KeithP, they tell you what to do and where to send stuff 

    Study post 2 in the newbies sticky thread and also the first couple of posts in the defence template thread, especially the email address picture plus the 12 steps
