1p mobile debiting my credit card without authorisation

    I changed my method of payment to 1pMobile to a virtual card which is attached to what Starling call a "space" (what you might call a "pot") and I keep nothing in there except when I plan to make a payment to 1p. This stops what happened previously which was that even if I had a decent balance, they'd take £10 from me each month.

    Using up all the credit and not topping up is not the way to signal you do not agree with the new T&Cs.

    What you should have done was migrated away to another provider. Or phoned them up and said you want out.

    Anyway according to website they don't support American Express:


    They definitely accept Amex, at least for legacy customers. Its what I always used with them and what they have charged me with here. I dont buy I have to migrate away for a pay as you go. I can just stop using it. They dont have a divine right to help myself to my cash forever more and I didnt accept any t&cs.

    You can just stop using Pay As You Go normally, but when you use a service with a minimum usage requirement, you do need to tell them that you wish to cancel or port out if you don't want to engage with them. 

    If you had removed your card details when you stopped using it, I suspect you would not have had a problem and that they would just have cut you off when they couldn't deduct an amount to cover the minimum usage amount (either from your balance or the card they had on file.) They couldn't have sent you a bill as you didn't agree to a credit agreement.

    By leaving a card on file you did give them a Continuous Payment Authority, and where there was insufficient credit to cover the minimum usage they would argue that they were entitled to recover it from there instead until the service was terminated. Changing your card details via Amex wouldn't work as card details are updated via the CPA so 1p would eventually get them. You need to remove the card from 1ps system entirely. 

    Your argument needs to be that you expected and wanted the account to be cancelled per the emails they sent, not that you never entered into an agreement with them. You enter into an agreement when you start using the SIM and you are deemed to have accepted any changes they impose if your account remains active post the effective date of those changes.
