OK, then just copy and adapt a recent witness statement that cites Chan and Akande which you can search the forum for, and almost copy.

And do this on or before 5th September (end of next week).
PLEASE do the government's Public Consultation while you can:

We understand that you may need some pointers. It looks laborious and you may not be that familiar with the worst conduct of this scam industry, we get that.

But you can call their worst conduct out with little preparation needed and you'll protect millions of motorists and help change the law.

I've written some guidance on that thread.

Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please!

I finally got a day off work!

I am currently drafting a witness statement of defendant (fished from another thread) and will submit it after I contact the court on 09/09 to confirm whether the trial fee is paid. Is this the best/correct approach?

In my WS I have included all the info regarding my fallen parking permit and my right to park there but the main part of the WS refers to the Chan and Akande cases and the lack of information in the claimants POCs.

Earlier in this thread Le_Kirk wrote about answering claims that aren't there. Is it necessary to include my part of will just the Chan/Akande parts be enough?

And I have started to complete the public consultation forms too

    A day off well spent!

    Nicely done.

You should first cite Chan and Akande as a Preliminary Matter but then do add some facts into the WS because not all judges will be swayed by Chan & Akande.

Another one bites the dust! Went to court this morning. Fully prepared with amazing help from you all! Moorside legal representatives never showed up so judge dismissed the claim, and was extremely happy to do so! The judge was an absolute gentleman, we had a little chat about these parking predators and he agreed with everything I said. It is a massive drain on the system and he sees this rubbish every day. And he encouraged me to claim back my expenses for the day too, he was adding it all up himself! Unfortunately I didn’t need to take the day off work to attend so couldn’t claim for that but i will in future

Again thank you all so much for your help

To anyone who is nervous about attending court you shouldn’t be. I was a bag of nerves for the past few days but attending today made me realise that they are on our side. It was actually quite a fulfilling experience
Yes it is, isn't it? Empowering. Well done!

    ANOTHER ONE BITES THE DUST!
