Cancelled EJ flight lost Disney holiday

I am really hoping for some help. I’m so upset. 

 EasyJet cancelled a flight to Paris on 8th July 3 hours before take off. The flight was due to leave around 9pm. The only flight they offered us instead was Wed 10 July 2 days later. As such I lost my hotel booking, 6 tickets for Disney over two days and 6 premier pass tickets at a total loss of £3100 (Hotel and Disney refused to reimburse me). 

I flew out again on the Wed but had to re buy the Disney tickets and re Book a hotel. My insurance declined cover on basis that the airline cancelled the flight. The flight was cancelled for staffing issues so I did manage to get the standard EU compensation which totally around £1320 for the 6 of us. But I’m still hugely out of pocket. 

I lodged a claim with ADR aviation. EJ are defending my claim on basis they aren’t liable for consequential losses. 

However is there any merit in arguing that it was their obligation to get me to our destination asap including via re routing or other airline if need be (which I understand to be the case) and they did not - they only offered me a flight 2 days later which is what caused my loss. There were so many other flights to Paris they could have put me on. 

Has Anyone got any insight if this argument has any merit ? And is There anything else I can argue ? Thanks so so much. I really appreciate any input.

    How much discussion did you have with them about this at the time?  As you say, you could have argued to them that their proposed alternative failed the 'at the earliest opportunity' requirements, and even if they'd refused to improve it, you could have booked yourself onto something more suitable and claimed the difference, but if you simply flew on their offered flight then I don't think you'd be able to sustain a retrospective claim now.

    Two days later for a flight to Paris seems a long delay.  Did you establish why this was the case?

    Did you seek to identify alternative routings and put to EJ to transfer you to?
    There are so many flights each day to Paris from so many airports, plus train and road options, that I can't believe nobody thought that something better than two-days later could be possible at the time.

    Presumably you were at the "airport" at the time. Why didn't you make alternative arrangements there and then. Declining EJ's alternative flight offer. 
  • Well easy jet has done all they could, they paid you your EU261 payment.

    Still don't understand why travel insurance declined? Unless you have one of the really cheap ones then it doesn't matter as they will always find reason not to pay - but they should be responsible for the loss.

    Regarding lesson for the future - you should have asked EJ to put you on another flight on the same day even with different airline as well as using train. You could also suggested buying them yourself and asking them to pay you back.

    Right now any further compensation can be received from travel insurance - feel free to mention the name so we know who to avoid 
  • Travel insurance would probably cite not minimizing your losses as a reason not to pay out.

    We had this exact issue recently with EJ to Paris - their website was crashing to re book flights and when we did get through were offering 3 days ahead - we were only going for 5 days. 

    Instead we booked flights from the nearest airport the next morning - with EJ - and got receipts for all our different train / bus journeys / hotel. EJ have paid out their flight tickets quickly - the price went up £400 as we were booking - and paid out the person that booked the flights for the food to tide us all over. Our one mistake has been to try and save EJ money we all shared a room but another traveller paid for it - because they weren't the main booker it has been declined on my claim (my OH's credit card) but we are appealing and hope to get that money back - in hindsight we should of perhaps paid for 2 rooms instead of one - or I paid for everything - but that was well over £1500.... All other payments were made within 10 days so enough money to pay the credit card off.
