Bury Angouleme Paid in wrong place, now received fine..

Hi.

Same situation as in below.:
https://forums.moneysavingexpert.com/discussion/6342020/smart-parking-fine-angouleme-retail-park-bury-landlord-wont-help

I've just got a letter from the same company(smart parking) , I've paid for the parking but it seems like I've used the wrong machine(the one I've used was for bury council parking, 3 meters away from parking spot)
I dont have a tacket anymore but it is visible on my bank account as payment to Bury Council
Any advice on appeal or should i pay the £60

It’s not a fine. Stop calling it that. It’s just a speculative invoice for an alleged debt for allegedly breaching a term in on their signs.

Just write an appeal to them using the exact wording below. No telling them who was driving.
This is an appeal by the registered keeper - No driver details will be given. Please do NOT try the usual Group Nexus Trick of asking for driver details in order to get around the fact your NTK does not comply with POFA. As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @ POPLA. Please therefore cancel the notice or issue a POPLA code where you will auto withdraw

    Do the above, online.

    DO NOT ADD ANYTHING.

    DO NOT TICK 'DRIVER'.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If this were ever to get to court I fear that the PPC might struggle
You never know how far you can go until you go too far.

My initial plan was to explain the situation?
Should I just copy above and say nothing else in the appeal.
I'm just worried if this can affect my credit score as I've got remortgage soon?

    1) definitely not, that could cost you money, less is more

    2)  correct, use the appeal wording by Grizebeck, appealing as keeper

    3) definitely cannot happen, stop worrying, no chance at all

No blabbing about who was driving, just follow the advice given above, no changes, no explanations

    1. No.  ABSOLUTELY NOT!
    2. Yes, honestly it works!

    3. Impossible.

NTK means Notice to Keeper, the first PCN letter that arrived in the post, presumably that is you if it has your name on it, because its the same details that are on your V5c log book

Popa isnt a word , probably a typo for POPLA that you have seen somewhere, irrelevant. !

POPLA, Google it, its the secondary appeal step if Smart rejected your first appeal as keeper, the one posted by Grizebeck above

No, you are saying that as the registered keeper you are appealing as keeper

You are definitely not telling them who was driving, this keeper appeal is about the law, nothing to do with who was driving, nothing to do with the incident or location

Dont overthink it, just do exactly what you are told

They Will either reply asking for the drivers details. ( Ignore if they do. )

    Or

They will reject the appeal and issue a Popla code

    Or

    They will cancel the PCN

Whatever they reply with, come back here for further advice, no rushing, no action until guided by us
