    I don't understand.

    This still isn't right and reads a bit ChatGPT. When I suggested Googling it I didn't mean use an American bot to write it.

    You did get a NTK (the final reminder that cites para 8 of the POFA is trying to be a hybrid NTK, following what they are calling a postal Notice to Driver).  None of it makes sense, as there is no such thing as a postal Notice to Driver.

    I am writing to formally complain about the recent Parking Charge Notice (PCN) number 123456789 issued on 27/9/2024.

    I question the validity of this PCN on the following grounds:

     * The first notice received was a final reminder, denying the keeper the opportunity to pay the discounted amount or appeal the PCN.

     * Inconsistent Citation of Regulations: The PCN was issued 'by post,' yet it cites paragraph 8 of Schedule 4 of the Protections of Freedoms Act 2012. This paragraph exclusively pertains to windscreen PCNs.

    I request the following:

     * Evidence of First PCN: Please provide verifiable evidence substantiating the existence of the supposed first PCN, including proof of postage and delivery.

    If Euro Car Parks fails to address this complaint satisfactorily, I will be forced to escalate this matter to the BPA.

    They have replied, in the newbie page it's mentioned to not be scared of debt collectors letters.  So based on that, do I ignore this? 


    Please be advised that the Parking Charge Notice (PCN) has been forwarded to the address of the registered keeper of the vehicle at the time that the PCN was issued.

    This address has been provided by the DVLA.

    Please note that we are unable to accept your correspondence as this parking charge notice has now been passed to a debt collection agency.

    Please contact Debt Recovery directly with regards to payment on 0208 234 6775.

    Euro Car Parks are unable to assist any further, please ensure all/any communication must now be complete direct with Debt Recovery Plus.

    Dear Sirs,

    I think you've deliberately missed the point.  My contact was a formal complaint because it is my position that you did not post a PCN.

    It is a complaint.  The BPA require you to deal properly with complaints and not fob them off.  I will not accept being fobbed off. I repeat:

    1.  Prove you sent a PCN.

    2.  Explain why you cited POFA paragraph 8.

    It is a complaint, not a SAR.  If I'd wanted a SAR I would have emailed your DPO but I didn't.  I used your complaints procedure.

    Get over yourselves and reply to my complaint; this is getting silly now.  Attached is a copy of the vehicle v5C which shows I am the keeper.

    I have a reply from ECP,

    Further to your email received on 10.11.24, a further investigation has been completed and I can now confirm the following:

     

    - PCN 88888****** / VRM - AB10CDE

    - Vehicle Entry - 27/07/2024 – 21:57

    - Vehicle Exit - 27/07/2024 – 22:49

    - PCN Contravention – Your vehicle has overstayed the maximum time period allowed

     

    The PCN was issued on the 06/08/2024 at St. Peters Wharf Retail Park.

     

    Signage on site is quite clear in its intent and clearly sets out the rules and regulations of The Site and the tariffs (if applicable). By entering The Site, parking and leaving the vehicle the driver has accepted the “contract” and therefore if the driver fails to comply with the terms and conditions as stipulated on the signage a parking charge notice will be correctly issued.

     

    The PCN was issued on 06/08/2024

    The Notice to Keeper was forwarded on 06/08/2024.

    No appeal/response – Final Notification letter was forwarded on 05/09/2024.

     

    Euro Car Parks accepts no responsibility for individuals failing to receive their letters. Letters are forwarded to the registered keeper's address which is supplied via an electronic link directly from the DVLA.

     

    Please contact Debt Recovery directly with regards to payment on 0208 234 6775.

     

    Euro Car Parks are unable to assist any further, please ensure all/any communication must now be complete direct with Debt Recovery Plus.

    Dear ECP,

    Now I'll have copies of that NTK and reminder letter under a SAR, please.

    There is 'no wrong door' for a SAR but to stop you gnashing and wailing and trying to delay coughing up the copies of those documents, I've copied in your DPO email address too.

    You've already seen my V5C so you have my ID. You have one calendar month to supply the two documents.

    The complaint is not yet resolved so you may not mark it as completed.

    Finally, please don't pretend that I'm your customer. No private parking firm appears to have a customer service ethic, and victims of PCNs aren't "customers". Your team name is insulting to consumers, so kindly don't reply hiding behind the misnomer 'Customer Services'.
