Hi All, 
I have read multiple threads and the newbie page. There are mixed opinions and I want to be safe and not make any mistake. Hence this post.
I got the letter in the 1st week of September for the fine which was on 27/7.
Parked to watch fire works which was after 10pm, but wasn't aware after retail park is closed 8pm you're allowed only to park for 10 minutes. Normally, it's 3 hours free parking.
I have now received a letter from the debt collectors. 
I have left it too late. What should I do, email eurocarparks with the template on the newbie page or email the debt collectors?
Reason for delay, tried to contact a radio station for legal advice but couldn't get on the show.

    Thats a final notification letter, a reminder , so lets see the first one, the initial NTK PCN letter 

    Clearly its too late to appeal, so try plan A in the newbies sticky thread in announcements 

    Ignore the debt collectors, post 4 in that newbies thread

    It is not a fine.

    Do not reveal the driver's identity. Everything should be done in the keeper's name.

    As above, start with Plan A, a complaint to the landowner and the keeper's MP. If the driver didn't realise there were parking restrictions, then it would indicate that the signage was inadequate. Get photos of the site and signage.

    The fourth post of the sticky Announcement for NEWBIES explains what to do about powerless debt collectors, but in short, ignore them.

    Do not ignore a letter of/before claim or a court claim.

    It shouldn't be too late to appeal as that first paragraph reads that the keeper has named you and this is your first notice.

    Is this a leased/hired vehicle?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    This was the only NTK received. There was no letter before this.  
    I'll ignore the debt collectors post.

    From all the posts, I have understood that it's an invoice not a fine,  so thanks for confirming. 

    I also gathered this point of not revealing the drivers identity.  Sorry if I'm coming across as "I know it all".. you have way more knowledge, hence needing your expertise. 

    I'll get the signage photos and email the land owner and MP. But I have found that,  land owner asks to appeal and MPs don't respond. Is there a template for this?

    Sorry , didn't comprehend the past point. I will not ignore any letter of a court claim. What is the other letter you are referring to? A claim letter from eurocarparks?

    Good to know that it's not too late to appeal. Yes this is my first and only notice. 
    I own the vehicle not leased or hired.

    My next steps:
    Newbie page, copy the text from there and email it to eurocarpark and ensuring to not disclose the drivers identity.  Is this the correct approach? 

    I remember you saying in a post, less words are more. So no need to write a PhD thesis for my appeal.

    The notice says that a PCN was issued 'by post' but then it tries to rely on para 8 of Schedule 4 which only relates to windscreen PCNs.

    It is too late to appeal it, as that letter you've shown us is dated seven weeks ago.

    But instead complain online that no PCN was served by post or to the driver, so why have they cited para 8 of the POFA? Make them explain and prove the existence of the supposed first PCN.

    You won't be paying but cannot appeal.

    I'll be complaining as a keeper,  but will that not give away the fact that I am liable to pay hence I'm the one questing?

    Sorry but I want to add to this, 

    Schedule 4 para 8 says,

    "(4)

    The notice must be given by—

    (a)handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or

    (b)sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period."


    Or am I looking at the wrong para/Schedule?

    You are misunderstanding.  That's talking about the SECOND notice.

    Paragraph 8 is only applicable when the first PCN was in the windscreen.
