    That all depends on the exact wordings and terms and conditions in your lease agreement 

    What exactly does it mention regarding private parking company charges.  ?  ( Invoices. )

    If the lease company received the NTK PCN letter and forwarded a copy, they already know, plus they should be following the BVRLA guidelines, so are they doing all that. ?
  • So I’ve emailed the parking company my address and name and they have now sent me the fine direct.

    However, they are ignoring my requests for further information advising:

    For GDPR purposes and as this has not been correctly provided during the appeal request”

    no idea how this isn’t correct, I literally emailed my name and address and they sent the fine to that location!

    my email address is not the same as my formal name. I had no idea it had to be! But they are basically refusing to continue discussing via email now - anyone got any ideas how to take this further please?

    Appeal as hirer/lessee online. I doubt appeals can be done by email. See back of the PCN.

    Which parking company. ?  MK1 Parking. ?

    Have you received a Notice to Hirer PCN. ?  (. or just a copy of the original. ?  )

    You have been told the steps back on page one

    So... has the lease firm failed to transfer liability to you? Force the lease firm to do that.

    I received a notice from the hirer end of last week. Lease company also confirmed they tried to transfer today, but it’s too late anyway as notice has already been received.

    The parking company is MK1 parking and the appeal on the back says to follow instructions on  their website or post an appeal. I’m unable to appeal on their website as I receive an error “Sorry, there has already been a previous appeal for this PCN”.

    It says the hirer/keeper has advised I were the driver of the vehicle at the time the parking charge was incurred. It’s not a copy of the original, it’s a new one with my name on it.

    This is a PCN under BPA

    OK - good that the NTH has arrived - so now go to MK1's complaints policy page (all BPA AOS members must have that) and lodge a complaint as the lessee/hirer, stating that MK1's website is denying hirers the right to appeal.  It seems to have counted the lease firm's transfer of liability (wrongly) as an 'appeal' which then blocks the hirer who now has a NTH and wishes to appeal. This is unacceptable and the hirer/lessee wishes to have this complaint logged as both a complaint and an appeal. The driver will not be named. POPLA Code please. If the right to appeal & POPLA access is refused then the appellant will complain to the BPA.

    I checked the BPA AOS members list before my previous reply and the complaints link was on the right for MK1

    If the NTH letter addressed to you was done properly with a different reference number then their website should have allowed a hirer appeal online, not a blockage like you described 

    What coupon mad told you to do is what I was thinking as the next step, once you gave clarifications, so follow her sound advice, complaint including hirer appeal using the complaints link
