No - even if they could prove the debt was originally yours, the Prove It letter is deliberately designed to not leave you having acknowledged the debt.  If it is statute barred, it stays that way! Don't be tempted to give them any more information than they already have for you, by the way, so if they have addressed you as "Miss J Public" then that is how you refer to yourself - don't furnish a full first name, new title or amended surname. Personally I would also be inclined to not physically sign a hard copy letter - just type your name.

Thank you for that because they have addressed me using my maiden name (I haven't used that name for 20 years) I would have responded with my married name.
Could I reply to the email or does it need to be post.

When dealing with any matters of a financial nature, especially disputed debt, for clarity, and for the avoidance of doubt, you should respond by sending the prove-it letter, in the post, not by email, emails get ignored, or sent to a spam folder.

The letter sets out your dispute, and asks them to provide evidence of your liability, it is deemed to have come from the sender, wear as an email could have been sent by any Tom, !!!!!! or Harry.

Thank you will print it today, otherwise I will forget again until they next contact me 🙄
  • Hi, I have just opened the very same letter. Signed over from Arrow to Capquest about an unknown debt with Shop Direct (Carval). I have found an address for Capquest I believe in very small print at the bottom of the letter, is this where I should send the ‘prove it’ letter?
    Many Thanks

    Capquest`s complaints/disputes address:

    Make a complaint by letter
Submit your complaint in writing to:

    Capquest Group
    Capella Building
    60 York Street
    Glasgow
    G2 8JX

You are essentially disputing the debt, so send it here.

The Reigate address is the head office.

  • Brilliant, Thanks so much. I will get that sent off asap 👍🏻
  • Did anyone ever get a response. I’ve got the same letter today. No idea what it is and has my maiden name. Been married 16 years. Going to send the prove it letter tomorrow but wondered if anyone had had a response to it

I have not had a response but I have received another letter. My letter is dated the day before the one they sent so they probably passed in the mail room.

New letter says the debt is £196.30 but they are offering a one off final settlement of £39.26 or clear account in 12 months £58.89.

They are clearly desperate to get something because they know they have no right to be pursuing this debt.

I think it's very dodgy dealings because some people will just pay the £40 to have it gone and sorted but debt is over 20 years old.
