    Please note that it was an invoice pcn from a private parking company that you received,  it was not a fine or a penalty from an authority,  so dont let them bamboozle you with incorrect legal words 

    You might owe them the fee if they correctly worded it into the contract you signed,  otherwise you didn't agree to it because its probably not mentioned at all

    Check, add proof , dispute if you have the solid ground

    Dear Sir/Madam,

    The parking charge notice in relation to the incorrect administration costs applied by Hertz UK Ltd has been cancelled, please see attached proof of cancellation.  Any cost-related dispute in relation to costs associated with processing the incorrectly issued invoice should be taken up with its issuer.

    Traffic Fines and Penalties
    You are responsible for paying the full penalty for any parking fine or
    charge, traffic fine or other penalty you incur during your rental.
    Fines Administration Charge
    Standard charge to recover our costs of dealing with any road charge,
    parking fine or charge, traffic fine or other penalty you incur during your
    rental.

    As stated in the contract terms and conditions quoted above, the hirer would be responsible for any parking fine or charge incurred by the hirer, as this is not the case in this instance, and given that the charge has been correctly cancelled, no valid charge or penalty was ever incurred by the hirer.

    Furthermore I plan to email Hertz UK Ltd customer service department directly with the following:


    "Hello, I am being contacted by a debt collection agency on behalf of Hertz UK Ltd regarding an administration fee for an invalid and cancelled parking charge notice.  This parking charge has since been cancelled by the issuing authority, I have attached a screenshot of the payment page showing the cancelled parking charge.  As per your terms and conditions of rental the hirer will only be liable for parking fines and charges that they actually incur, as no charge was incurred  in this instance and no violation committed by the hirer there should be no liability for any administration costs on the hirers behalf in this instance."



    Any thoughts are welcome and sorry for making this so long winded - wish me luck!

    Remove 'issuing authority' and 'fines' and 'violation' (none are right for PPCs) and remind them that this was only an invoice. Say that, and all of this:

    Point out that the BVRLA confirmed on 2/7/2024 (two months before Hertz even got the PCN) the following:

    Simply transferring liability (filling in a slip or sending a template reply to parking firms) does not cost Hertz anywhere near £44. Even if this sum was hidden in the hire agreement small print somewhere, it is a disproportionate unexpected financial burden - whether the PCN was later cancelled or not - and the term also fails the test of 'prominence' which is mandatory in the Consumer Rights Act 2015.

    As such, the £44 charge term was not agreed and is unfair on at least two counts. Unfair terms are unrecoverable. Further, professional debt recovery firms will know from the FCA CONC rule 7 'Disputed Debt' (required to be followed by CSA members) states that:

    "A firm must suspend any steps it takes or its agent takes in the recovery of a debt from a customer where the customer disputes the debt on valid grounds or what may be valid grounds."

    So after sending the reply I have received the following from the debt collection agency, I have received no reply from Hertz even after trying their customer contact department twice.

    Thank you for your email and thank you for completing security.

     

    I can confirm Hertz have passed your account to EOS Solutions debt collection with an outstanding balance of £42.

     

    Please see attached a copy of the said invoice. When this has been reviewed, please call our office on 01925 816626 to discuss this further and agree payment resolution.

     

    Failure to do so may result in further debt collection activity including; litigation, charges being added and a field agent visiting your address.

    It seems they are threatening to pay me a visit in person, I feel inclined to just pay the £42.00 and get them off my back but I know in my heart of hearts I am being ripped off by these people, really dont know what to do and would appreciate any help...

    I haven't phoned them yet but I get the feeling the matter is not up for discussion, they want their £42.00 and that's that.  I'd also prefer to deal with them via email so all correspondence and communication is recorded.

    I will not be phoning them, any correspondence with them I want to maintain in email form, so far I have not replied to the below email.

    Hello I was phone called by the debt collector company today and asked to pay the outstanding balance of £42.00, I already stated that the invoice has been cancelled they said that they need to see proof, I have already sent a screenshot of the web page which shows £0.00 oustanding against the PCN number.

    My question is would it be worth contacting Group Nexus and ask for confirmation that the invoice has been cancelled?

    No just ignore them. This is the debt collector for Hertz though? The fact that the PCN was cancelled is only slightly relevant.

    Hertz think you owe them an admin fee.

    Your answer is: I don't, I didn't agree to this and the PCN was cancelled anyway. If the admin fee was in your t&cs, it was not sufficiently prominent and is wholly disproportionate to the work involved, so it fails the test in the Consumer Rights Act 2015.
