Group Nexus PCN received - Hire vehicle

Hello all,
So back in August this year I needed some repairs done to my car so off to the body shop it went, I hired a car to cover me for the period in question, returned it when the hire period expired
and went on my merry way.
So recently I received an email from a company which I hired the vehicle from in August and included in the email was an attachment PCN 'reminder for payment' sent
to the rental company from Group Nexus (the rip off parking company), the rental company included the following in the body of the email:
Rental Agreement Number: ---------
Vehicle Registration: -------
Reference: -------------
Date/Time: --/--/---- --:--
Authority Name: GroupNexus Appeals Dept
Document Type: Parking Charge Notice
We are writing to you because during your rental in the UK, we were informed by the authorities that a traffic violation or parking offence was committed while you were using our rental vehicle.
In accordance with our rental conditions and applicable legislation, you are responsible for all such charges incurred in relation to the vehicle during your rental.
We have provided your contact details to the relevant authority, to transfer liability to you for this fine. The authority will contact your directly to recover payment for this fine. In addition we have applied our standard administration fee of £ 42.00 for the processing of this violation.
A copy of the fine is attached for your information (unless it is a speeding fine, which legally must be provided directly to you by the relevant police authority).
The authority will contact you directly in due course.
Sincerely ,
On behalf of
---- (UK) Limited
- NTK 'reminder' issued: 30/09/2024
- Date of alleged contravention: Late August
So clearly, the original NTK was sent to the hire company but they have only forwarded me the 'reminder', I do not have a copy of the first NTK which the hire company would have received, given that the rental company has now passed on my details to Group Nexus I assume they are going to contact me with demand for payment soon.
My first issue is that on the day of the alleged offence the pay terminals were out of order, so whoever was driving the vehicle at the time of the alleged offence would have simply exited the car park accordingly, and it seems from reading the hundreds of negative reviews about this absolutely abhorrent company that many other drivers are suffering a similar fate; seeing pay terminals out of order only to receive demands for payment weeks later. Also the rental company has stated in the body of the email (above) that they have charged £42.00 for the administration costs of sending the PC the hirer details however (and thankfully) no such payment has been taken from my account and I have cancelled the card which was used to purchase the rental period.
Thank you and kindest of regards,
Silent9174.

I have read the NEWBIES FAQ and at first assumed I should go with Plan A and contact the retail centre/supermarket to complain about the situation, I havent replied or done anything as of yet, I would really appreciate some help here and I'm just wanting to keep this thread open and update it accordingly as events go by.
I would welcome any thoughts and/or suggestions to kick things off in the right direction.
Thank you and kindest of regards,
Silent9174.
Here is the invoice from the PC:

Plan A is always the best option, complaining as keeper. ( Hirer. )
You redacted the dates so difficult to advise you about some aspects
The hire company should have named you as the hirer, cin which case wait for a Notice to Hirer to arrive in the post, before appealing please note
There is no authority
There is no fine
The hire company are wrong about both of those, and they should have forwarded a copy of the actual initial NTK PCN letter, not the reminder1 -
Wait for your NTH then win at POPLA by copying any recent NTH POPLA appeal. Very easy.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD1 -
Thank you both, I will do just that.1

They have conned you out of £42 because what has been received is none of the things mentioned in their letter to you.
Here is a list of all the words that your PCN is nothing to do with:
GroupNexus is not an AUTHORITY. They are an unregulated private parking company. No TRAFFIC VIOLATION has been committed. No parking OFFENCE has been committed. There is no FINE because a private company cannot issue fines. The Notice to Keeper (NtK) is an invoice.
So, look at what the morons have written and compare what it says in your rental agreement:We are writing to you because during your rental in the UK, we were informed by the authorities that a traffic violation or parking offence was committed while you were using our rental vehicle. If there is no mention of voices from private companies, then they have breached your contract with them.
The authority will contact you directly in due course.2 -
Hello and thank you all for your replies and support.
If there is no mention of voices from private companies, then they have breached your contract with them.
Yes, the companies rental agreement states that the driver is liable for 'fines', therefore it can be argued that the parking charge notice is not an official fine.Update 16/10/2024: today I received the following document in the post from the rental company, they have invoiced me for some outlandish 'administration charge' for God knows what, I wont be paying this and they can keep sending these to me, I will prefer to let a judge decide before I give these scammers a penny.
Thank you all again.0 -
I wonder why that Hertz invoice uses the word Penalty at least three times?
No penalty has ever been issued.
And it continues to use the term relevant authority when referring to the parking company CP Plus Limited.

Update..Hello guys thank you for all your replies!Yesterday I received an NTK in the post, just a point of note: GN have dropped the proposed "fee" from £70 to £40 if paid by 11/11/2024.I still refuse to pay as this will likely make me also liable to pay for the rental company admin fee charges, the whole thing feels like an utter scam, I would really like to know what should my next step be? Should I appeal online and then wait for the refusal and appeal at POPLA?I have attached copies of the letter sent to me.Thank you again for all your support.0

Edit: Sorry, this is a notice to the alleged driver which has been sent because the hirer (keeper) has notified GN of the hirer details.

Appeal as hirer stating the usual hirer appeal statements, especially regarding the non compliance with POFA 2012
Ditto with any subsequent Popla appeal ( plus no landowner authority and no hirer liability. )
Absolutely no blabbing about who was driving
Bear in mind that your dispute with Hertz is regarding the lack of private parking company invoices, parking charge notices, definitely no "authorities" involved either1
