Study this recent case too

There are plenty of recent CCJ set aside cases you can research for guidance2 -
Thank you I’ve read that. When is an good time to request the set aside, should I realistically give Nexus 2 weeks to respond to my email or should I just get on with it?0
-
You have to act quickly, so give them a short deadline to respond, a deadline date would be good, personally I wouldn't give them more than 2 weeks, so definitely by the end of October, but I have never been in your position
I do know that time is of the essence, to act quickly, so perhaps study timescales in other recent set aside threads ?2 -
I called the CNBC again this morning and the address used was my previous address. We moved out in June 2024 and the CCJ was issued in August 2024.All of my bank statements, utilities etc would have even updated within 7 days of moving.1
-
Ok, so that proves incorrect service of papers ( wrong address used, so I would expect you to obtain a set aside on that basis. ) you were unable to respond because you knew nothing about it
I hope that you updated your driving licence and also the V5c log book too, with the DVLA3 -
Ohhh, I haven't done my licence. The car has long been sold and my new car is registered in my address.
Is this going to a problem?
I would like to argue they managed to find me when it was time to pay, so they should have done the same when sending the papers?0 -
But changing your driving licence (or changing the address on a V5c) when you moved wouldn't have been visible to a scam parking firm. Stop worrying.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you, that is reassuring - and ties in what what I have been reading.
OK so a waiting game now for a reply to the email and then in the meantime I will compose my set aside form.
Thanks for all your help so far!2 -
Hello everyone, I received this from DCB Legal
Dear XXX,
We write further to your correspondence dated 11/10/2024.
For the avoidance of doubt, Judgment has now been entered against you on 28/08/2024 in the sum of £236.69.
If payment is made outside of the one calendar month, the Judgment will simply be marked as 'satisfied' on your credit file. If payment is not made, the same will remain on your credit file for a period of 6 years.
We acknowledge your comments advising correspondence had been sent to an old address you no longer reside at. In order for us to review the matter further, we request evidence of residency August 2024.
Failure to provide the same within the next 14 days will result in your circumstances not being taken into consideration.
Kind Regards,
XXX

Is it worth responding with proof of my new address, or do I just move to requesting the set aside?
Thank you all again.

Send the evidence by email today - including dates if you moved well before August - and a copy of your own online credit file that shows the new address from THE MONTH YOU MOVED - and give them seven further days now to agree that their client pays the £119 and applies to set aside the CCJ by consent at zero cost to the Defendant.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
