    I have got an update on MCOL:

    It reads like this:

    Your defence was received on 15/10/2024

    Your defence was rejected on 11/11/2024

    Your defence was received on 11/11/2024


    Does this mean the old one has been replaced with the new one I submitted?

    I've had an update on MCOL that the DQ was sent to me on 15/11. I haven't received anything as of yet.

    Is this received in the post? How long should I wait before chasing this up and who would I get in contact with?

    I've received the defendants DQ stating "after reviewing the contents of your defence, the client wishes to proceed with the claim". This was dated 12/11 and I received it through post on the 15/11. I'm hoping the issue of the confusion of writing the defendant as myself initially hasn't given them ammunition to win!

    Now that you have seen that the CNBC has sent a DQ to you, you can always download one and complete it without waiting for one to arrive by post.

    It wasn't sent to you. It was sent to the Defendant by post.  I know this sounds pedantic but that confusion caused your wife to have no signed defence in for a whole month.

    Nothing is to be done in your name except Mediation (she can nominate you to do the necessary 'tell them to get stuffed' 5 minute phone conversation at that stage only).

    I emailed the DQ to the same email address as the defence and also to DCB with plenty of time before the deadline.

    I haven't had any update on MCOL. Should there be one at this point? 

    This is how MCOL appears currently:

    Your defence was received on 11/11/2024

    DQ sent to you on 15/11/2024

    DQ filed by claimant on 15/11/2024

    If you emailed it then they might reject it, but they are very busy and currently backlogged by a fortnight or more 

    You were told that the defendant should email it, not you. ! In which case its at the back of the queue 

    Plus there should have been an email response to show it was received by the CNBC, you have not mentioned it

    Then you sent it to the wrong place.

    Item 10 on the checklist in the opening post of the template Defence thread clearly states which CNBC email address should be used.

    You still have plenty of time to send it again - to the right address this time.   :)

    Good spot, totally different email addresses, as seen in the picture in the defence template thread, first post !

    Dicing with danger here , they changed the email addresses at the beginning of march

    But that's not what the first 12 steps in the Template Defence thread told your wife to do. This is the second error.  She's risking a CCJ again. Please just follow the steps we provide.
