Defence advice for a car park legal case

    I'm re reading the defence and it is written about me, my travel and my work. My wife was not in the car and so I'm not sure how it can be adapted to her being the defendant?

    Should it be re-written as "my husband, in his capacity as a dentist......."

    I would greatly appreciate your advice

    Just use what @Le_kirk posted earlier, but change the defendant to the driver in every case.

    Remembering of course to slot those words into the rest of the template.

    Easy. Just do it now.

    I don't think she can make changes.

    To do that she'd have to pay £119 and ask for relief from sanctions for the mess up and ask to amend the defence formally, via form N244.

    I say she signs it 'as is' IMMEDIATELY.  

    NO CHANGES.

    Currently, she has not defended her court claim.  This should have been sorted a day ago. Stop delaying and reading the defence. Just do what I said.

    She is about to get a CCJ because that defence will be rejected once looked at.

    You'll have to change that.

    Do what I said and keep checking MCOL because if the defence is rejected, she COULD bung in a new (proper) one.

    I will keep checking MCOL. Please can you expand on how she might do a new one? Is that through the formal process via form N244 as you mentioned before?

    Or just log the new defence straight on to their system via MCOL

    No.  You need to re-read what I said.  I said if the defence suddenly shows as REJECTED she might be able to quickly email - or maybe even enter on MCOL - a fresh one (and beat them to judgment).

    Have a proper version signed and ready and check MCOL daily.  Pounce if the old defence is rejected.  It then becomes a race.
