    All the POPLA template stuff is old and we are sorry about that.  It hasn't been a priority to update because the Government is committed to bringing in a single appeals service.

    POPLA is so unimportant most people here just never bother with it and obviously ignore PCNs.  You could do that instead. I would. My friends do that when I help them. I almost never try POPLA for friends.  Nobody pays.

    As I'm at POPLA stage and you're saying that I could only possibly win by taking pics of the signage which demonstrate the lack of T&Cs RE £100.
    Yes that can be more likely to win at POPLA but why care either way? Nobody pays.

    Have you not yet looked around a bit: browsed the recent posts in POPLA DECISIONS at the top of the forum and noted that where an appeal is lost, NO-ONE pays?

    Have you read the third & fourth posts of the NEWBIES thread more carefully than just panicked skim-reading to copy some words thinking that's how to make it go away?

    Where in any post do I tell people to pay?

    I assume this is better than messaging any retailers directly?

    RE POPLA - not replying would inevitably lead to potential court action? And a CCJ?

    OK ive just sent the following to the retail park:

    Dear customer service team

     

    We received a harassing letter (attached) from UKPC, the private parking company who are presumably agents sub-contracted to "manage" a private area on your behalf, demanding payment of £100 for parking in a private loading area.

     

    We stopped by at the onsite Lidl at the time. I am a regular shopper here as it is near our home. Whilst parking, we noticed an issue with my vehicle so had to pull into a disabled bay. Whilst waiting for 20 mins for the AA and whilst shopping on the on site Lidl, I am dismayed to have received a parking charge.

     

    Now we are being asked to pay an outrageous value of £100. We live in the area and have been customers of many business at the Horns Retail Park for many years including Lidl, B&Q and many more so it is extremely disappointing to be treated this way.

     

    Me and my family and myself are furious that you appear to have appointed one of the most litigious and notorious ex-clamper firms here, to intimidate and ultimately to sue shoppers, yet it seems that your contract has included no 'customer service' consumer-focussed clause giving a right to veto PCNs, to the Store Managers, who have told us that they hate the regime and it is losing them custom in droves.

    The Lidl Manager believed he could do nothing about it which is shocking, if true. You are our last hope and I sincerely hope you will step in and cancel it with your aggressive agent. Such firms offer nothing at all to consumers. We spend £100s per month usually with these shops and will never return if this continues to court, and we will be telling all our friends and other pet owners to avoid this retail park as it is a no-go area. No wonder retailers are dying out, when landowners inflict these firms on shoppers.


    I ask that this charge is cancelled and that "UK Parking Control" are advised to desist from sending us any further harassing letters.

    oops, youre right about the reason for stopping - i copied from a template (which I will now update).

    RE POPLA - just to be clear - are you saying ignore it or appeal to POPLA? I understand that youre saying its not worth the effort - hence why I should ignore?

    Or do you think the extra effort and draft an appeal to POPLA?

    I have received a response from the email : info@cspretail.com

    They have said they are not the landowner and that I should contact them directly but were unable to provide any info for them?

    What to do now?

    Find out the actual landowner or managing agent for that private property and complain about the PCN to the correct people 

    Plus 

    A Popla appeal, if the Popla code has not expired , using up to date arguments, mainly based around poor signage and no landowner authority

    That was your task since the beginning of last month 


     The advice that you are receiving is the best advice for your predicament, nobody said that its quick or easy, there is no magic wand to make this disappear, we are telling you the best strategies to employ, sometimes based on recent cases, but always with the objective of getting the PCN cancelled 

    Its a bit like Mission Impossible 

    Your task, if you choose to accept it, is to get the PCN cancelled by any legal means at your disposal 

    We guide you towards the correct paths to follow, be they dead ends or otherwise 

    Retail parks tend to have managing agents working on behalf of the landowner, the businesses are tenants, so bound by their contracts with the managing agents. Parking companies contract with the managing agents
