I submitted my appeal as follows
We informed Premier Park we had not received a PCN so were not given the opportunity to provide them with a driver name. They simply sent us a Final chance before action" letter demanding payment. A company cannot be a driver and therefore cannot be fined. We would ask you to reject this PCN.
POPLA have now repliedYou have made us aware you have not had the opportunity to view the operator’s case file. Please find this attached.
You have until 3 December 2024 to provide your comments on the case file. The quickest way to do this is by replying to this email.
Please note that these comments must relate to the grounds of appeal you submitted when first making your appeal with POPLA, we do not accept new grounds of appeal at this stage.
Any comments received after the above date will not be considered.
POPLA attached Premier Park statement as I posted earlier plus some photos and their internal paperwork.
Again, any advice would be greatly appreciated.

If the pcn was in the company name , plus if the driver was not outed, then you should be checking on what makes you liable, if you appealed the PCN as a company or as a hirer, meaning are you personally liable under POFA. ?
Presumably your Popla appeal contained legal points ? So you should be checking if their evidence pack can hold you liable under POFA 2012
Its worth checking if you are liable as driver, because their evidence pack features heavily on driver liability, if they know who was driving. Clearly the driver was in breach of the parking contract rules, but are you. ? Maybe not1 -
The PNC was allegedly in the company name, but we never received it. The first thing we got was the Final chance letter demanding payment. We replied saying no PNC had been received, we are the vehicle's owner and keeper and asked Premier Park to confirm it does not hold C2H liable for this parking charge and that this is now purely a matter between Premier Park Ltd and the driver. They simply emailed saying our appeal had been rejected.Even if you are a minority of one, the truth is the truth.0
