Thank you. Please excuse my ignorance on this subject, but who is appealing? If you recall the final chance letter was addressed to the company, the company wrote to Premier Park and they responded to me. And I'm still confused about what I'm appealing. I've trawled lots of templates about "lessee", but I'm not leasing the car. Thanks for referring me to the anacronyms.Coupon-mad said:Context is irrelevant because the hirer wins easily by using any NTH POPLA appeal.Even if you are a minority of one, the truth is the truth.1 -
The company appeals.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

On the grounds that a company cannot be the driver. Only the driver is liable unless the NtK is fully compliant with all the requirements of PoFA. You, on behalf of the company, are appealing and explaining that the company cannot have been the driver. It is the operators burden to prove who was driving and no assumptions or inferences can be made.flyer said:

And obviously the usual wording about compliant NTHs, found in every POPLA NTH appeal.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Every template I've come across refers to querying the NTK issue, but we have never actually received a PCN, so how can I dispute a PCN that we have never received?Even if you are a minority of one, the truth is the truth.0
