Claim Form from Civil national buisness centre

Hi all, i have received a letter today regarding a PCN i received from the Captiol Centre in Preston. The fine is for “Not parked correctly within in the markings of the bay or space”. I wasnt parked anywhere near a space and was actually parked next to a curb where some bins are stored. But there was no double yellow lines where my vehicle was parked

    Post the name of the parking company Claimant, the lawyers if used, plus the issue date on the claim form, plus the date you did the AOS online too

    Also post a redacted picture of the POC on the bottom left of the claim form, hiding the VRM details 

    Its kerb, not curb

    The PCN is probably for not parking within a marked bay

    What is the Issue Date on your Claim Form?

    Can you please show us a picture of the Particulars of Claim - with all personal detail hidden of course.

    Who is the Claimant?

    Upon what date did you file an Acknowledgment of Service?
    Your MCOL Claim History will have the definitive answer to that.

    And i uploaded the Acknowledgment of service today, 27/09/2024

    With a Claim Issue Date of 24th September, and having filed an Acknowledgment of Service on 27th September, you have until 4pm on Friday 25th October 2024 to file a Defence.

    That's four weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    This is what I have so far for my defence paragraph. Does this read ok or does it need to be changed? 

     

    The defendant admits to being in the Capitol Retail Park to visit the branch of Starbucks. The defendant parked alongside the kerb in an area beside the Starbucks. The defendant did not see any signage or markings (such as double yellow lines) indicating that parking in this area was prohibited.

    I don't think that's appropriate.
    CEL v Chan is used when there is no explanation of the driver's wrongdoing.
    Seems quite clear to me that the driver is accused of parking outside of a bay.

    Does UKPC already know who was driving?
    Do you realise that a keeper has more protection in law than a known driver?
  • No ukpc doesnt no who was driving but it was the registered keeper that was driving, can you advise me of how i would file a defence for parking not in a bay, i have filled the rest of my letter out its just that section
