 Hi

Apologies if this is in the wrong place. I'm not au fait with tech, forums, computers, internet, websites, etc. I am a newbie and have read the advice but I'm still a bit confused and I just want some help and advice.
Unfortunately, I contacted the private car parking company before reading this forum and all the advice you give.
Sorry, this is pretty long-winded but I want to give as much detail as possible.
My partner (owner/keeper of vehicle) received a parking charge notice on 23rd July from Azure for a charge on 3rd July.
I was the person driving on that day. I had permission to enter the car park by one of the businesses using it, an Art Gallery.
I pulled in, one piece of art was unloaded, I had a quick chat with art show organiser and left. I did not park in any of the parking spaces.
On receipt of charge letter, I spoke with the art gallery manager and was told Don't worry, Azure do this all the time. He provided me with info showing the details/wording used in successful appeals of charge notices received in error by others at that location. He told me the only camera working was the one facing the entrance (how Azure got the car reg). None of the other cameras work so Azure can't/won't/don't have any proof of parking.
Armed with this, and fully confident that it would be dismissed meaning no more letters to my partner, I contacted Azure online, gave them my details and explained that yes, I was the driver and had entered the area. I asked them to provide evidence of the car parked.
Heard nothing back from them.
On 2nd Sept, Owner/keeper received letter from ZZPS.
I rang them and told them I had already provided Azure with my details so why were they still contacting the owner. They told me they couldn't do anything about that as they only had the details provided by Azure.
I rang Azure (noticing that both companies have similar numbers and the same address).
Again, I gave them my details, my explanation for entering the space and reiterated I didn't park. Again, I asked them to provide the evidence showing the car parked.
They claimed, they tried to contact me using the email I had provided on 23rd July but got no response so they passed it to ZZPS.
They claimed they had an incorrect email address to the one I had provided.
They said that now they had the correct details, they would pull it back and contact me by email.
(A few times during the phone call,
I pointed out the same address and similar numbers and asked if they are the same company. No, of course not, he assured me.)
Finally, he said, if I had any queries, I could ring them anytime. I asked, on which number and he said ZZPS! even though I had rang Azure and he had insisted they were 2 different companies.
I have had no contact from them.
At the weekend, my partner (owner/keeper) started getting texts from ZZPS. He has ignored them as he knows I have contacted them twice and given them my details. I didn't give them his details i.e. phone number, email, etc
Today 23rd Sept, my partner has received an email from QDR, saying 'an important and confidential letter awaits you. Please click here and complete the security questions to view it.'
He didn't do this.
He is getting quite fed up (as am I) with it all especially as I have already given them my details twice now!
After reading the advice MSE/forum has given to others, I realise that I should never have contacted either Azure or ZZPS, but what can I do now?

Thanking you in advance

Your partner must contact the complaints email published by Azure and tell them that they already have the name and address of the driver (who is YOUR NAME / ADDRESS).  As such, continuing to process his data is illegal and they must take the matter up with the driver and cease and desist sending demands to the keeper.

Promise us NEITHER of you will phone these scum firms again and that you will NOT pay!

Just be careful. C may say a transfer of keeper liability can only be done by the RK. It may be worth providing details again for an easy life.

that said, obviously the provisions of PoFA re RK liability are only invoked if C doesn’t know who was driving and of course they do here.

There is a lot of confusion around this
If a driver appeals a NTK and clearly states there were driving then keeper liability can NOT apply
There does not need to be a formal liability transfer.
  • Thanks for your replies.
We certainly won't be phoning them again!

When my partner emails Azure telling them they already have the driver's details, does/should he include my name and address?  or just state that they already have the details?

Do we ignore anything received from ZZPS and QDR and only deal with Azure?

    Thanks again for your help/advice.

Of course your partner should give Azure your name and address. If you've read the Newbies/FAQ thread thoroughly, you will already know that you ignore anything from ZZPZ (or GCTT), QDR and any other debt collector.

My reply made that clear with the bit I deliberately added in brackets... It's why I put it in capitals!

  • Thanks again for your help.
We have sent the email to Azure as you advised.
What should I do when they contact me?
  • Depends on what there correspondence says. You can ask here for further advice if you can't find answer in NEWBIES thread or are unsure.

Please read the forum first. The NEWBIES thread covers everything.  Every stage.

We don t need to see every letter or tell everyone what their next step is.

We can't because we regulars answer some 100 questions per day in our own time and hope that most posters will read the NEWBIES thread first (at every stage) as this is primarily a self-help forum with an Announcement thread resource.

Post if unsure after reading the thread.

  • Hi
I have literally spent hours over the weekend reading the Newbies thread but keep finding myself reading posts from say 2013 about size of font on signs or something that seems totally irrelevant to me.
I am so anxious now to keep asking for help as I really don't want to waste your time or !!!!!! you off.

They (Azure) replied to my partner's email giving my details saying they are no longer dealing with this overdue parking charge and to contact QDR directly.
    He has replied:
As I said in my previous email i am not the driver of the vehicle in question and you was informed of this
Please cease any further action regarding this matter with myself and take it up with the relevant person
I am not going to use up any further of my time dealing with your company's mistakes.

All your advice says ignore QDR but can they bring my partner to court without his knowledge?
(We haven't opened the link in QDR email received last week so have no idea what it says.)
I/we have had authentic Penalty charge notices dismissed in the past but that was when dealing with reasonable people who, once they have my details, deal with me without any problems.

I really appreciate the help you have given me, I  have never been in this situation before and it is very worrying.
