Thanks for your response @Coupon-mad. I wasn't actually aware you were able to opt out of the scheme so I will have a look into this ASAP. Much appreciated.
Of course you can and must.  Absolutely opt out and don't ask, TELL.

The scheme offers nothing of value to you, causes you harm and there's the 2023 case law to show the MA that they can't impose restrictions like this.

  • So I have received a court email saying i will be receiving a call for mediation, would you recommend I try settle with the mediator? Does that mean they intent to pursue if I don't come to a settlement?

Mediation advice is in the 12 steps you were following

Answer,  definitely not,  unless you offer £0 , both sides walk away,  bearing their own costs , and it's accepted by the claimant

The case definitely continues as usual if no agreement is reached

    Of course not.

Please re-read the two links we provide, all about what to say at Mediation stage.

No. Please re-acquaint yourself with the first 12 steps in the Template Defence thread.

    Hi all,

Just wanted to follow up that this got discontinued!

However, I have received a different PCN and subsequent claim form from DCBL due to different parking charge (this wasn't residential) - I have filled an AOS. but I have seen that on the claim form, they have used a shortened version of my name (not my full legal first name) - For example 'John' instead of 'Johnathan' (not my real name). Can I use this as a main point in my defence?

Please post a redacted picture of the N279 discontinuation document below in regards to this dead claim by DCB LEGAL on behalf of Bay Sentry

DCBL dont issue claims,  but DCB LEGAL Do, so please start a n̈ew thread in regards to the new claim

No it's not a defence point, just fill in the preferred name,  which is where you are given the opportunity to do so right at the start

A defence is written based on the POC,  the core details regarding the alleged breach of the parking contract,  not about names, but do get out your V5c and check it
