complain to smart , as long as you submitted the appeal it should have been cancelled, its well known for them to do this
get your wife to email appeals@smartparking.com tell them when you appeal, and that you will complain the BPA if not resolved. , you have to double click through on their appeals page twice and sometimes people dont do that

I have an appeal reference so I assume it was submitted and they obviously acknowledged the appeal by email!

When I looked on the BPA AOS page the smart parking complaints policy link took me to 'smart parking' complaints page, giving me the email address complaints@smartparking.com. Should I get my wife to send it to this and appeals@smartparking.com?

The keeper can use both if she wishes, but the BPA may require her to use their link, so maybe use the BPA AOS link first. ?

But either may work , maybe add the appeals one as a cc in any email. ?

    I'll send to both emails.

I can't find a link on the BPA website? I've gone to 'Public Advice' on the BPA website, then AOS members and then found 'Smart Parking' and clicked on 'complaints policy'.

I can't see a link on the BPA website to complain to BPA about Smart Parking. I'm basically sending an email to Smart Parking's own complaints department. It says that they should respond to all complaints within 28 days and they are kept on file for 36months for authorised bodies, which I assume is BPA, to review.

The BPA AOS members list shows this if you click on their parking company complaints link on the right of the Smart Parking line

    https://www.smartparking.com/uk/uk-complaints-policy

A complaint must be made in writing via email or post:

    Email: complaints@smartparking.com

Once you get a reply, if they fail to address your complaint, you complain about it to the BPA AOS compliance team online, on the BPA website

But I posted what to do in September on this thread. Admittedly I was replying to a thread hijacker but I provided the exact keyword search to do and said that a formal complaint was required when this happens.

All too common from Smart & DR Plus.

Obviously your wife ignores DR Plus. There's no deadline.

    Hi,

Update on previous post on the 11th September!

After receiving acknowledgement, by email, of my appeal (on the 14th September) I had heard nothing regarding the fine. I have just been going through some unopened letters and have found a letter from 'Debt Recovery Plus' requesting the payment of the fine. Unfortunately the letter was dated 1st November and addressed to my wife who is the registered keeper of the car. She is a nightmare for opening post! They want payment in full by today (15th Nov) or I can choose to pay in 4 instalments or do nothing. Obviously they point out doing nothing would mean they start legal action.  The letter doesn't refer to the appeal being unsuccessful?!

Is this a scam or is this a company employed by Smart Parking Ltd. to recover the debt? Surely Smart Parking are required to respond to the appeal and comment on it?

On the acknowledgement email it says 'the Appeal decision will be sent to you soon'. I have received nothing from them.

Any thoughts on the best way to proceed?

Thanks for any further advice you can provide.

Have you done this now to the complaints email? Then to the BPA?

Got it cancelled? Nobody pays Smart Parking.
