Smart Parking Ltd. Parking Charge Notice



Hopefully someone can offer some advice on this.
My wife, who is the registered
keeper of our car, has received a parking charge notice (£100, £60 if paid within 14 days) from Smart Parking. The date of the offence is 17th
August 2024 and the date issued is 2nd September 2024 although I have
only received the PCN in the post today (11th September 2024).
I paid for the parking on the day via RingGo however the time shown leaving on the PCN photo was 10mins after the parking finished. We were back to the car in time, but we were leaving on a long journey home (about 5hrs) and by the time we sorted out the kids, dog etc. we left the car park after the parking finished.
Is there any grounds to appeal this?

Use the below via their website.
No need for a million questions or responses"This is an appeal by the registered keeper - No driver details will be given. Please do NOT try the usual Group Nexus Trick of asking for driver details in order to get around the fact your NTK does not comply with POFA. As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @ POPLA. Please therefore cancel the notice or issue a POPLA code where you will auto withdraw"

As above. 100% slam dunk easy win as long as the keeper does this, not you.

A letter has been received by the same company yesterday, the difference being we have received a reminder (we did not receive the original charge letter) I cannot appeal!What advice would you provide? They state in the letter the charge is from may and that they sent the letter in august!0

Smart debt recovery plus first letter
and read a good ten threads about what people did when Smart and DRP played this game. It is a very common scam and requires formal complaints.

Hi,
Update on previous post on the 11th September!
After receiving acknowledgement, by email, of my appeal (on the 14th September) I had heard nothing regarding the fine. I have just been going through some unopened letters and have found a letter from 'Debt Recovery Plus' requesting the payment of the fine. Unfortunately the letter was dated 1st November and addressed to my wife who is the registered keeper of the car. She is a nightmare for opening post! They want payment in full by today (15th Nov) or I can choose to pay in 4 instalments or do nothing. Obviously they point out doing nothing would mean they start legal action. The letter doesn't refer to the appeal being unsuccessful?!
Is this a scam or is this a company employed by Smart Parking Ltd. to recover the debt? Surely Smart Parking are required to respond to the appeal and comment on it?
On the acknowledgement email it says 'the Appeal decision will be sent to you soon'. I have received nothing from them.
Any thoughts on the best way to proceed?

Check your inbox and spam folder for any email replies
Go to the BPA AOS members list on the BPA website, look at the complaints link for Smart Parking, complain about the lack of response to your appeal, giving them the PCN details, VRM details and the name and address of the appellant
Come back here when you get a response
Ignore the debt collectors letters2 -

A heads-up - never in any comms refer to the speculative invoice as a "fine" - you will not find that word in any comms from the parking company.3
