Private Parking Charge Notice LDK and ZZPS

Hi everyone,

A bit late to this but might have a chance to win as no payments have been made yet. 

Received 2 separate NTK for two different dates from same company. It is very misleading as the parking site has suddenly changed from council restrictions to private. This means restrictions are now 24 x 7 instead of Monday to Friday 8am to 6pm.  

Incident 1:

The first alleged incident was end of April 2024 and instead of receiving the initial notice from LDK, a late payment notice was received from ZZPS on 22nd June 24 demanding a large amount that includes late payment and debt recovery costs. Unfortunately this letter did not have any guidance to an appeals process and the debt collectors made it clear that the appeals time had elapsed. Also, with it being a new experience, there was driver acceptance here but continued to dispute the payment on the basis that the first PCN was not received which allows a reduced payment or chance to appeal. Also, it is highly likely that the initial NTK is beyond 14 days of the alleged event (it if exists). ZZPS were asked to send a copy but were unable to do so. Shortly after an email from QDR solicitors follows. After searching online, an online appeals form was found for LDK which was used to submit the dispute a month ago - no response so far. The main dispute is that the initial PCN was not received thus to pay a hefty fine is unfair. The unclear signage was also mentioned. 

If you can provide any further advice for Incident 1, it would be appreciated. 

Incident 2:

Alleged incident May 2024 and the NTP received 9th September 2024 - driver information has not been provided.  The NTP does not say "Protection of Freedoms Act 2012". There is an appeals process but as seen on other threads, the first appeal is usually rejected and you get a POPLA code. This will be appealed directly with LDK first given that it is still within the appeal window. One key question, is LDK still required to provide the NTK within 14 days if letter does not mention PFA 2012? Other reason for appeal is poor signage. On the appeal, should incident 1 be mentioned? Any other advice for this appeal would be appreciated.

No it's still with ZZPS. Have a look bottom right of the supposed 'QDR letter'. It's from ZZPS.

Further to the above; 

Incident 1 (driver identified)

There was no initial notice to keeper from LDK allowing an appeal. The first letter with debt collection charges came from ZZPS on the 22nd of June. Out of panic, contacted ZZPS, confirmed driver and mentioned that initial NTK was not received thus would like to appeal. ZZPS said appeal window has elapsed. A month later the letter below is received via email from QDR. Spoke and emailed QDR to explain situation to no avail. Thus submitted an online appeal via LDK website. Appeal was on the basis of not receiving initial notice and also the signage is very poor. It has been over a month with no response from QDR on the email sent (they state that they will respond within 10 days) and neither from LDK on the online appeal. Concerned if it is getting escalated in the background. Any advice at this stage will be highly appreciated. 








Incident 2

For incident 2 the below has been received a couple of days ago from LDK dated 03/09/24 for an alleged event on 20 May 24. This looks like the initial notice and provides details on appeal on reverse. There has been no contact with them so far. Again, any advice on how to approach will be much appreciated.

Safe to ignore even if driver acceptance is there for incident 1? What is likely to be the next steps from QDR?

Letter from LDK for Incident 2 has an appeals process - should this be explored?

Nothing will happen except letters re PCN 1 and my advice has not changed and won't change. Nothing has escalated. Don't show us the ZZPS letters. The QDR letter is from ZZPS.

Re the new one: do what the NEWBIES thread tells you.

Which bit of "We are instructed by ZZPS on behalf of LDK..." is not obvious that QDR are simply acting as debt collectors and are hoping you are low-hanging fruit on the gullible tree ripe for the picking? ZZPS cannot "instruct" anyone to issue a court claim as ZZPS are not a party to any contract that the driver has allegedly breached.

Have you read the Newbies/FAQ thread where it is all explained in great detail on how this all operators and what you should and shouldn't do, especially things like blabbing the drivers identity before understanding whether PoFA has been fully complied with?

Thank you everyone, for incident 2 I understand I should appeal within 28 days and the increase to charges will be put on hold too. I have a few days to hand. Sorry very new to this and do feel the anger for being misled by scammers. 

Is the template below OK to use for the first appeal with LDK?

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner. (how do i get the landowner details?)

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle. (I have seen pictures of the vehicle on paymyparkingcharge.com - there are two picture, once with just vehicle and other with registered keeping outside driver door of vehicle.) Not sure if that makes any difference to how the appeal is done?

If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it. (do i add this?)

If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. (do I add this?)

I also want to mention about the unclear signage and anything else I should add or omit, please let me know.
