    User1977 - yes, worst case scenario is the buyer loses the driveway and sheds/extra width of side and back garden which has been created. If they wanted to fence or divide off the land to what is actually owned then they would have to do that.

    I can't see a reason why they would wish to do this rather than carry on using the land as I have, mainly down to the fact that nobody has had any issues whatsoever and it is assumed that the driveway etc. is part of my land. If I were to continue living here for the next 30, 40, 50 years I am sure there would be no problems, it is purely the potential sale of the house/land that is raising this tricky issue.


    Section62 - all of what you say is pretty much spot on in regards to gating orders, rights of way, the idea of the pathway providing access to rear of other properties.

    When we bought, the hedge on our side of the pathway was about 3 or 4 foot thick! So the 2m wide pathway was actually about 1.5m - no way of getting a car down there. The entry at the other end of the industrial unit area is much wider and much more suitable for cars and vans.

    Also, directly behind my owned land/back wall is a yard for one of the industrial units, hence there is no alley running along the back of the row of houses on my road (hope that makes sense?). So none of the neighbours could reach the rear of their house down the pathway and then turning 90 degrees, there is just no access.
