Okay thanks - what's the likelihood it will be accepted?Gr1pr said:
In that case you can appeal as the driver with the suggested sentence, nothing elseJezzaP01 said:
Sorry that's my bad - I went back onto the appeal email and there was oneGr1pr said:Your earlier reply said that you didn't receive a Popla code
If you did, you can only appeal to Popla as the driver, using the words provided by Grizebeck
Or can I just ignore it now as you originally advised or could it be taken to a simple claims court?0 -
Only other thing I've just noticed is who they've addressed the letter to - it is an old company name which we are no longer using. Does this make any difference?Grizebeck said:
Yes that's rightJezzaP01 said:
Cheers @Grizebeck - so work through the POPLA claim and just submit that one line as you have suggested?Grizebeck said:No
Do the appeal to popla as I suggest
You will win
End of
You ask what it will do..it will get the ticket cancelled of course. What else !0 -
There are several scenarios, none of which can really be predicted
Its either ignore if the appeal did not reveal who was driving or about the story in the first post, due to no keeper liability , but I suspect that you gave it away, most people do due to blabbing
Or you appeal to Popla as driver using the template sentence kindly provided by Grizebeck , seeing as you are now stating that a Popla code WAS provided
Its your choice to make
I doubt that Smart would issue a claim via the Sheriff for a single PCN within the next 5 years, I definitely won't speculate on the justice system in Scotland, its difficult enough for the England and Wales system
Grizebeck has told you their preference2 -
Crikey!! Nearly thirty posts in less than an hour!!3

OK, I am in the 'ignore' camp.JezzaP01 said:
Especially now that you have revealed that the PCN was sent to a non-existent entity.
As an aside... you must of course update the DVLA with up to date Registered Keeper details.
In your opening post you mentioned a failed appeal.
Who actually appealed? The 'new' company? An individual? The 'old' company?3 -
No more thoughts need. Use the text I've told you to use.
Than let us know when it's cancelled
Really it's so simple and you didn't need all this waffle
Anything else you mention is irrelevant. Come back in a few weeks.2 -
Fair point - send me £100 in the post if it failsGrizebeck said:No more thoughts need. Use the text I've told you to use.

Smart have obtained the keeper details from the DVLA database using the electronic link, as it is the correct procedureJezzaP01 said:

There is a legal requirement to keep the details up to date and the DVLA could prosecute via the magistrates court or similar for not doing so, a possible £1000 fine could be the result of any court case
The keeper should be getting it done online ASAP

Jeez... so many posts over 3 pages for the sake of the simplest POPLA appeal as advised by @Grizebeck and it still goes on.

OP, just to the one line POPLA appeal or simply ignore it. End of!1
