    Just a comment on your proposed paragraph 3...

    Firstly you explain how the driver bought a ticket.
    You then go on to say the Defendant bought a ticket.

    Does the parking company already know the driver's identity?
    If not, they will when they read that.   :)

    They dont know the drivers idenitity

  • 3. At the time of the alleged offence, the driver of the vehicle visited Walsall Waterfront ANPR car park to visit shops within the retail park. The defendant purchased a ticket using the PaybyPhone service using the vehicle number plate, The defendant paid the correct parking fee and there was no breach of contract. There is no cause of action. This charge attempts to penalise the Defendant, who bought a ticket but the system has malfunctioned.

    The defendant has been harassed with letters since 2021 but believe these to be false as he purchased a ticket for the time at the car park.

    Do not call it an "offence". Calling it such, gives an air of "authority" that the PPC most certainly does not have. Call is an "event" or "contravention".

    Also, the fact that the defendant has been receiving letters is not harassment and has absolutely nothing to do with the defence.
