Mis-sold Debt Between 2 Companies, That Are Now Pursuing My Client To Pay

@JustJinny - thanks for the feedback.
I'm sorry - and disappointed - to hear CAB were not much help. This is the sort of thing they should be dealing with.
Forget about getting a solicitor. It would only be worth doing if you could find one willing to give half an hour of free advice. I'd always understood that CAB should be able to provide a list of local solicitors who are willing to have an initial 30 minutes free consultation. Have you asked CAB if there are any?
I don't think you need a solicitor anyway - and it will cost your client more money anyway.
If you live in a university town you might find that their law department offers a free legal clinic.
Hopefully the other forums will be able to give you good advice.
Good luck!0 -
The idea of small claims is that it's supposed to be simple enough for people to defend themselves. Even if you do find a lawyer, you're unlikely to be awarded the lawyer's fees if you win the case.
If it sticks, force it.
If it breaks, well it wasn't working right anyway.0 -
When Sky "buy out" a contract, I don't believe they perform a financial transaction with BT. What they do is give a credit on the Sky account - are you sure this isn't what was supposed to happen here and your client was responsible for settling the early termination charge with BT? If the service was cancelled after 4 days, that may not have been long enough for a credit to be processed.JustJinny said:
Sky won't help, as their service didn't work in her area either, so they shut it after 4 days, and archived the account. We have an email from BT saying Sky has taken over, and there are no fees to pay. We submitted it to Court, but it was returned to us, saying only a Judge needs it.HillStreetBlues said:Have you contacted Sky to confirm the paid all fees? Better to get it in writing as would form part of your defence if it goes to court which I personally doubt.

Easier and cheaper for sky to credit their new customer's account rather than enter into a extraneous transaction with BT0
