Hi Guys,

DCB legal have taken me court.  I did as Coupon Mad suggested and sent them the first email.

I didn't receive anything and have ignored all other letters.

I didn't have my cards on me to make payments and couldn't use the phone service to pay for parking, instead paid with cash but don't have a record of it.

Would this be ok to still proceed with the case?

I left my cards at home and paid cash for it.   Issue date is 31st July.

I left my cards at home so was unable to pay for it, its not that I can't pay for it.   Issue date is 31st July. 

In which case you should have left the car park within the 5 minutes grace period allowed to pay or to leave. ( Not left it until a court claim arrived. )

So I suggest that you login to MCOL ASAP and complete the AOS online ASAP, to get more time to draft your defence based on the template defence by coupon mad 

Name the parking company that issued the PCN so are the actual claimant here 

Post a redacted picture of the POC on the left of the claim form, hiding the VRM details, also hiding the rest of the claim form too

With a Claim Issue Date of 31st July, you have until Monday 19th August to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 

To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 2nd September 2024 to file a Defence.

That's over two weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.

To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.

Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

That's not a PCN. That's a court claim form with an Issue Date of 31 July.

But it includes the MCOL password and a QR Code.  Report your post due to personal / sensitive data being in the image.

Thank you for your comments, Coupon -Mad.  I feel privileged that a famous person like youhas commented on my post. 
I am grateful for you correcting the error I made.

I was going to post my defense but it keeps on saying, I have to wait a little longer.  I have been waiting almost 11 hours now but still gives me the same message.

Does anyone know how long much longer I have to wait?  Thank you

We don't need to see the template defence.

Just show us your bit but written in your own words not by Chat GPT which is easy to spot a mile off and uses ridiculous long words in a really robotic way.

Don't state that you made a mistake. You didn't. You paid for parking with cash. Therefore the allegation that there was 'no valid payment' is false and is denied.

"The Defendant admits to parking the vehicle at the relevant location but denies liability for the alleged parking charge. The Defendant paid for the parking with cash but has not retained the receipt. Consequently, the Defendant requested the data of the parking machine to verify the payment but this request was not fulfilled.
