I didnt ignore Coupon mads question. I acknowledged it with a thumbs up. Apologies if YOU are offended by that. This is why I didn't ask any further questions and have not updated this post until yesterday. I followed Coupons advice, drafted and sent my witness statement. I didnt think I needed to 'answer' anything. I didnt want to add to the thread as Coupon gave me everything I needed.KeithP said:

All I'm asking now is just what to expect from a phone hearing. Does the judge do all the talking etc or am I allowed to talk? Not even asking for advice about WS or what to say. Ok. Once checking everyone is assembled, most DJs will describe their understanding of the case, invite the claimant to discuss (sometimes omitting that if the facts/allegations are fairly clear) before inviting D to respond. You’ll want to not only make your case, but to specifically address what the advocate for C says on the day. They’re often instructed late, so can get even basic info wrong. Again, be prepared for interruption by the DJ or possible direct questions to cut to the chase. Time is short.
don’t be afraid to:
1. That the court has your WS or bundle
2. to refer the court to documents or page refs of the papers you are speaking to.
3. As you’re by phone you don’t have the advantage of watching the judge and what points land/when s/he’s writing. Speak slower than you might normally do.
4. Make notes during the hearing. You may need to.
5. Challenge Cs the basis for the claimed costs even if you lose on the main argument over the PCN. The bolt ons and interest alone make turning up for the hearing worthwhile if you can knock those out.
6. Argue that C should be prevented from recovering legal costs entirely other than court fees. It’s a small claim and if you kick out any clement (eg the bolt ons) it’s likely to be a significant % of their total claim.4 -
Regarding point 6 above, if there are no lawyers involved, meaning that if PCM are representing themselves, object to any £50 legal fee, if they added it into the total claimed
You should check the claim form, top left for anyone involved, bottom of the form too check the figures
The above assumes a loss, so no asking us after the fact, costs etc are all dealt with at the end of the meeting, before dispersal
