I have recently obtained my Credit File you need to obtain your files for all 3 credit reference agencies, not just one, as different companies hold different information.to see exactly what is on there. It only shows 2 defaults - BOTH satisfied. (now I know I owe approx 45k to about 8 companies in total - this all stems from 2000-2001). But there is only these 2 satisfied defaults showing on my file.
I have been paying all the various companies (all DCAs, they all keep selling the debts on) on and off since I defaulted and they all call me regularly asking for more money etc.
2 of these defaults actually went CCJ almost straight away as well.
So, my question is, do I ask for a CCA from each of these companies? Do you think there is a reasonable chance that they will NOT have the correct paperwork and I will be able to stop them hassling me ALL THE TIME.It is quite reasonable to expect them not to have the proper docs if they have been passed on a few times.
I have been considering BR but I have a Limited company that is almost dead now, so I'm waiting to clear that up before I make a final decision on BR. This CCA thing might just buy me some more time. Probably will buy you time.if you need it
What do you all think??
ps. I LOVE this site - it reminds me I'm not alone in this big, bad, debt-ridden world!!!;)
thanks
If you are considering BR make sure the first thing you do is contact one of the debt charities and go through your options with them. If you ultimatly decide BR is best for you then the judge will ask if you have taken professional advice so better to get it sorted sooner rather than later. If you have any questions you would like to ask just post a thread and we will do our very best to help you.
We don't have much experiance of CCA's on this board. If you pop over to the Debt Free Wanabee board they have much more experiance and if you post a question about them someone will be able to help. Also if you put CCA in the search facility and select forum you will find there is lots of imormation on them.
Hope some of that helps.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -

My DMP is with CCCS and I was wondering whether to approach!! (prehaps not the right word, as they all seem completly UN-approachable) the Halifax with an offer of 5000 on a 9430 debt? as they have told me they are passing it to a DCA,(a friend said they could help as they are upset to see me so depressed) Do you only get a default when it is passed to another company? in other words would my record with them be clear if they agreed to my proposal or if they have defaulted me already would that still stay with me for 6 years anyway? sorry does that make any sense???!!!
It is always worth aproaching them to do a F&F, start by offering them lower than you have and you may be surprised, if they don't accept that slowely go up to what you have.
I am afraid once you have missed payments etc. then you will get a default and it is there on your file for 6 years.
Again if you pop over to the Debt free board and post a thread they will be able to help you on F&F's, suggesting letters to write etc.
What a lovely friend you have to want to help you out.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -
Thanks TF.
I have got my CF from all 3 agencies - Equifax, Experian & CC. All 3 say EXACTLY the same thing!!!
I have spoken to CCCS already. We are part way through the telephone interview, we are speaking again next week.
I think I will post this over on the other board as you suggest to see what they have to say as well.
Thanks very much - it's great to get all this advice from people who have gone through this themselves.:TI'm not so tired & not so desperate..... mainly thanks to MSEso just call me Notso.....
Yes, I'm juggling and I might drop some.... but at least I'm trying

Start your own thread so it doesn't get lost in someone elses and don't be embarrased to bump it up if it drops off the front page. The DFW forum is faster moving than ours as there is a lot more going on there.
Meanwhile have a read of this

Hi Kevster - Am I understanding you correctly? - You have never had a credit card with MBNA, yet you are still being pursued by Equidebt, despite their inability to provide you with either a copy of the original cca, or deeds of assignment.
You should report them to the Trading Standards Office and the Financial Ombudsman without further delay.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

Okay, kevster - but you have, have you not, already requested the cca and it has not been provided within the legally allowede time-span?
