    Dear Sir/Madam

    Re:− Account/Reference Number 4563210025897412

With reference to the above agreement, we would be grateful if you would send us a copy of this credit agreement.

We understand that under the Consumer Credit Act 1974 (Sections 77−79), we are entitled to receive a copy of our credit agreement on request. We enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

We understand a copy of our credit agreement should be supplied within 12 working days.

We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

We look forward to hearing from you.

    Yours faithfully
    Mr A N Other

Don't forget to send it recorded delivery and DON'T sign your usual signature, print your name.

I thought that if they called you more than 3 times a day then it was harrasment. You also need to send a 'please make all contact in writing letter' as well me thinks.

This is a link to NDL's article on harrasment. When you write you can quote the law to them

  • Tiger, why not sign your name? whats the reasoning behind this? (just curious)
The first time we said hello, was the first time we said goodbye. As the angels took your tiny hand and flew you to the sky-you forever left us breathless. RIP my beautiful granddaughter :(

Thanks ISA, TF and BLTN. I've also heard about not signing. Yes, they are harrassing me and it isn't even my debt!

Not saying they will BUT it is entirely possible for the [STRIKE]pond life[/STRIKE] lovely DCA's to copy the signature on to the correct paperwork!!

DCA's are wonderful people aren't they.

I read on another forum that someone had signed the letter and the DCA had sent the paperwork to them all signed. But it wasn't the debtors signature it was the person who had signed the letter who wasn't the debtor

OMG! Is it a high street lender? I would have never believed any of this could go on but after having financial troubles myself and dealing with banks, credit cards and DCA's nothing surprises me anymore. Now I'm going to send out that letter to all my husband's creditors and see what comes back. So they have 12 working days to reply. I'll get that letter and £1 postal order sent hopefully monday and start counting down the days.
