Why on earth did you not get medical assistance?
At the time of the accident I was mainly concerned with stopping the bleeding as we were due to collect our 5yo from a kids club within the hour. I managed this with wads of tissue. Once it had stopped I didn’t believe there was much else that could be done. I kept it covered with tissues and a bucket hat. I was taking paracetamol and ibuprofen for the next 4 days as my head was banging. But at the time I didn’t feel the need to pay my £50 excess for medical expenses for stuff I already had. Maybe in hindsight I should have gone to the hotel doctor but I didn’t want to cause anymore upset to my wife or son than was necessary.
Tetanus up to date, antiseptic to avoid surface infection, checks for concussion….it’s a head injury, you should have sought medical advice. Even if you didn’t seek medical help immediately, the fact you had a headache for 4 days would suggest that at some time you should have sought help. Even if just a call to your insurers to ask their medical advisors what you should do.

  • It seems the OP is in a minority of one thinking there is an ongoing case to pursue successfully.

How many other people had banged their heads on this dangerous bracket?

My husband suffered a similar injury when a heavy door that had  a coat hook attached to it closed quickly behind him.
The coat hook hit his  head.

When reported in the incident book and the manager yanked the hook off the door.

When his soliciitorr put in a claim they were told many other people had gone through the door without any problem .

Case was closed as unlikely to win.

Now that would be an interesting statistic to have the benefit of knowing. I would imagine that it is more than 1 due to its positioning, accessibility and lack of warning signs! But the botched insulation and tape over the metal brackets would soften the impact somewhat now I suppose.

I'd love to know what the warning sign would say.

Presumably the fact there was no protection means that it's not happened a lot.

The issue with warning signs is that it is an “admission” of something potentially unsafe as well - think of “beware of the dog signs”

By not having any warning signs, it”s easier to say “we weren’t aware”

I think the OP should live and learn, he “may” have had a case originally, but failed in a few directions at the time.

Hope apart from the scar all is ok now

If you are thinking about progessing this further I would strongly recommend not using terminology such as "imagine" in the claim.

Three days after they covered the brackets with foam insulation and duct tape. So if there was no issue there would be no need to put protective covers on the metal bracket.
It’s a little bit like when you have scaffolding on a street. The exposed metal is covered with foam to prevent injury.

I hadn’t looked at it that way but yes that is probably a valid point for not having warning signs.
On the flip side though surely if there were warning signs it should act as a deterrent?
Just like the caution wet floor signs around poolside to deter people from running and or slipping.
